Hi, Paul I wonder if you can help, please could you tell me if when someone buys a new build leashold flat asking price £134k and then the seller which is a company accepts an offer of £124k is it right for them to charge stamp duty on the asking price and not on the actual buying price, thanks

Sorry for delay in coming back. Ive only just got back to Wigan - from the weekend in Cardiff.

My area of speciality is Personal Injury - but I will speak to one of the guys in the office tomorrow and come back to you if that's ok

The short answer is that stamp duty is charged on the agreed price as quoted on the memorandum of sale, which is sent to both solicitors, the vendor and buyer. The only time I have ever encountered stamp duty being higher than the "real price" was when lenders were accepting a partial "vendor's deposit". I have been advising on mortgage for nearly 27 years, so pretty sure I'm right on this one, unless there is something really odd going on! cheers

Sorry, forgot to mention that Stamp Duty isn't paid to the vendors anyway, if due on a transaction then it is collected by the solicitor and passed on to the Revenue. The vendor has no say in whether stamp duty is payable or not, the buyer's solicitor does that. Any property being purchased for £125k or less is currently stamp duty exempt. cheers
