Legal Advice..

Thu Nov 15, 2012 9:43 pm

So I have a court fine to pay for vehicle related crap from a few years ago, thing is for some reason the courts have sent all the mail to my grandmothers house, while its been piling up there, bailiffs have been instructed in the final letter

I have no property there or have i lived there, it was jsut a postal address whilst i was in uni

do they have any legal right to take things from her house? don't want to scare the old dear

Best thing i can think of is if there open, phone them saying you don't live at the address or return to sender, I'm sure council bailiffs are to only ones that can enter the property even if nobody's home.

Provided you don't live there & have no possessions there, nothing can be taken. If the bailiff's are told this & subsequently take items, your Gran has a civil action against them.

Do not pay the bailiffs. You will pay considerably more than the original fine. Their fees will ensure that.

Contact the Mags Court that issued the fine & request a hearing for a means assessment. If the fine was imposed in your absence, it would be unlikely that the Court knew your financial circs at the time of the fine.

At the hearing the Court will reconsider your means & set a payment schedule. This is likely to save a couple of hundred quid in bailiff fees. Provided you make an offer to pay, the Court are likely to be sympathetic
