consumer rights? where do i stand?

Bought a refurb laptop from Barry laptop repair centre, & had no longer than a few days and the power Jack went on it... Bloke in shop appologised and fixed it...all fine then had it a few days and power went completelyand took it bk to shop the bloke said will ring when its fixed...didn't heard anything for About a week then after goin in the shop he said We spilt liquid on it... Which I know is a lie cos I didn't and I know the wife didnt, so the blokebsays its outta the guarentee as don't cover spilages, he said he will dry it out an c.What he can do.... 3 weeks later he still ain't done nothin... So my wife an mo in law went in and asked What was goin on and asked for money bk and the bloke started screaming at them saying f**k u f**k off etc... Whilst hes waving a cuppa coffee over how laptop... I know prob had no way.of gettin money bk etc but its a gd job o didn't go down cos I would've smashed his shop up the fat .f**k, now he says hell put it together for Monday as its still in bits an I have a feeling he's just gonna break it more anyway.. he also reckons the motherboard may have gone which is 150 to fix?

Firstly under the supply of goods implied terms act you have the rift to the 'goods' being of Satisfactory Quality, this is clearly NOT of SQ. remedies are repair, replace (with a like for like product) or you may be able to reject the goods if he cannot do either. You will prob need to put a formal letter in. Standard letters can be printed off the which? Magazine site, Martin Lewis money saving dude site, or Consumer Direct Wales.

If of course you paid a penny over £100 on your credit card you can also hold the credit card provider jointly liable under the Consumer Credit Act 1974, section 75.

If you paid cash and or it was less than 100 then you cannot use sec 75.

It's been a few years since I've been out of the job in consumer protection, so, double check and ring Consumer Direct Wales to check your rights before you kick off.

Also, most importantly, don't kick off.

You still have your statuary rights Chief. Double check on second hand though. But if a warranty was given then it should be honored. Under "Fit for purpose" You would expect it to last more than a couple of weeks, its depending on how much you paid for it. But the big question is if you can prove if water damaged it wasn't you. But you can make things awkward for him as under your statutory right its is illegal for him to deny you this right or for him to lie to you about it.

But if all else fails then i would consider one bit of advice from someone above and lean over the counter take the laptop of him and smash the fooker over the head with it WWE style. And then tell him look you have definitely broke it now. Now you won't get your money back then and you will most probably go to prison, but think of the satisfaction you would get from it.

Lol the way I was feeling other day I was on route to go bk down there n smash the CUNTS shop, but ill c What he's done to it, its his word against ours bout water damage... I paid 150 for it.. I would expect it to last a lot longer than What it has.. and Steve ill quite happily smash it over his head WWE style then give him a stone cold stunner
