Dave Jones contract .

Can somebody either confirm or deny that whatever salary Wednesday have given Jones then is it correct that CCFC have to pay the difference and top up his salary to whatever it was here before he was sacked ? And are we still paying Riddler too ?

Im not sure about about dj,but i'm quite sure riddler has been paid off.I think i seen it in 1 of carls updates

The accounts last week included a £172 K pay off cost for a director which in my opinion was Ridsdale so he has gone. DJ still has 3 months left on his notice period and he is entitled to claim the money. I think what will happen now is that there will be a negotiated settlement of that 3 months salary and the fact he now has another job will impact on that settlement.

So for me we will now stop paying him but he still will get a % of that 3 months salary. :ayatollah: :ayatollah: :ayatollah:

As usual it all depends on the terms and conditions of his employment contract, of which none of us has a Scooby :!: but let's not let facts get in the way... :D

When an employee is put on gardening leave and continues to be paid monthly in the usual way, then that arrangement comes to an end when that employee starts another employment contract, or a particular time period is reached. Jones has started a new contract, so under the usual rules of engagement his payment from CCFC would cease, though he would receive any severance payments he was due (notice, holiday (!) etc).

On a separate but related note, WTF did MAndaric sack Megson when they were 3rd??!! All kicking off down there with Clark getting the boot at Huddersfield as well, who were 4th. I would have loved to see Megson and Jones together, 2 of the most miserable people ever to grace a manager's position :x

I agree that the terms and conditions are very important in deciding if DJ continues to get paid or not. But it is not an absolute fact that payments will automatically cease when the person on gardening leave starts a new job. There is case law in the UK where an employee has successfully taken an ex employer to court and won the right to continue to receive payments due under their previous contract even though they were in a new job.

One example is that of Sarah Hutchings who was placed on gardening leave and then sent a letter to her employer informing them she intended to seek employment despite being on gardening leave. Despite the normal gardening leave conditions being in place with her contract of employment her former employer failed to confirm that gardening leave conditions i.e. payments and benefits would cease when and if she found employment. As a result she was able to take up her new role and continue to receive her salary and benefitys from her previous job.

I suspect but don't know that DJ would have had his agent and legal team all over the terms of his gardening leave agreement, hopefully the club has covered all bases. But his starting a new role at Sheffield Wednesday does not automatically mean his rights as an employee of Cardiff City end.

Gary - surely jones would want to settle ASAP - doesn't having two paying employers effect the amount of tax you pay?

I agree 100% Craig and if he is still entitled to claim his salary, and I say if, he would be able to negotiate a payoff which would be below the threshold for paying tax so it would absolutely be in his interests Having said that he still has 12 weeks notice left thats over £200k if his £18k per week salary is correct. I can't see him walking away from that if he has a chance of receiving it.

Hopefull Gethin Jenkins and Alan Whitely have done the paperwork properly and he has now gone off the payroll, but as I say a fancy DJ and his agent had some pretty good lawyers working on his behalf.

That why I think the reality will be that Dj will get something but not the full £216k. :ayatollah: :ayatollah: :ayatollah:

I'm not sure but i think if his contract included no clause regarding gardening leave then the club would have had to agreed a payoff sum payable as a one off payment. As he has remained on the payroll I think it is certain that the gardening leave clause was in his contract.
