My firm owes me £2000 in wages

And I have threatened to take them to court, when they realised this yesterday a director phoned me and offered me £480, I told him to shove it, what would you do?

Take the £480 without prejudice and keep onto them for the rest :old:

Good idea but it would make me feel uncomfortable.

Yep, that is the first stage without doubt. £2000, I think the next stage will be the small claims court.

That is a good start but you have to remember that an application to an Employment Tribunal has to be made within 3 months of the date that the wages were not paid.

So I would write to them giving a deadline and make it clear that you will submit an application if they fail to respond positively.

If the claimant wrote to his employer and headed the notepaper 'without prejudice' that letter cannot be used against him at a later date.

If the claimant wrote to his employer and headed the notepaper 'without prejudice' that letter cannot be used against him at a later date.

It would not stop the saying they made an offer and the defendant took a payment.

Ian what we are talking about is a settlement. If the claimant wrote to the employer and said that he would accept a £480 payment now and pursue the rest at a later, the employer couldn't say that the claimant was accepting a full and final settlement of £480, espeically if he headed the letter 'without prejudice'

The 'without prejudice' is there so that both sides can negoaticate a settlement without 'prejudicing' their position, in this case the claimants £2,000.

TBH as long as the claimant can prove he is owed the £2,000 (time sheets etc) he would win easily at an Employment Tribunal as it is illegal for an employer to withhold wages which are owed.

Easy.Small claims court action. Write to your employers telling them that you are giving them 7 days notice to pay you the sum of money that you are owed and that If no response is received then you intend to raise an action in the small claims court. Once an action is raised they then have (I think) 14 days to respond and if they do not then a jugement will be made against them.If they do contest the case then they will have to turn up at court and explain why you have not been paid. If you win your case then all monies including all your costs will be met by the employers side. So go for it.

I would sign on the dole and watch "Cash in the attic", "Bargain hunt" , "Jeremy Kyle" and in the evening you can watch "Eggheads"...........sounds bloody brilliant.
