Anyone itk about car insurance claims
My grandfather drops my gran and her friend off up the bingo every Friday
Back in August when my grans friend got out the car she closed the door on her finger therefore losing the tip of her finger
All friendly bla bla bla then yesterday
She posted a letter saying she had been advised to claim against his insurance.
What would be the best action regarding this
Nearly 3 months since the incident and only just claiming now etc
Has she got a solid case do you believe

Surely if she closed the door on her own finger she is liable. Not everything can be claimed for can it?

Don't dilly dally, pass the letter straight to the insurance company and let them sort it out. That's what you pay them for.

If it's like you said it is, then she doesn't have a claim, the silly cow. She closed the door, so she can only claim against herself. Third party liability will be covered under your grandfather's insurance but how anyone can feel that he is liable for that, I just don't know. I've been in the business for 27 years, by the way.

That's wxacty how it happened aswell. He has pncb but it's the increase in premium that could affect him

It won't increase directly from that if his NCD is protected, plus if it's a claim they don't pay out on, then it won't count, protected NCD or not.

I deal with Personal Injury Claims for a firm of Solicitors.

The first rule of any claim is negligence. That is to say you can only sue the person who was negligent.

In this instance the negligent person was herself and therefore, regrettably, she does not have a claim.

Now if the driver closed the car door on her finger that would be different but, by her own admittance, she closed the door on her own finger.

No claim - Sorry.

Quick update he didn't have any third party Injury liability or whatever it's called so he's been told they can't claim through his insurance so they would have to sue him. Anyone heard of a case where someone is sued because they jammed finger in car door

Sorry I ment he doesn't have legal expense cover so the car insurance wouldn't be an issue they would have to sue him personally

Read Paul Kevill above and you get your answer so she will never get representation from a no win no fee solicitor. If for someone incredable reason the old granny decided to press ahead any way she would have to find the money to hire solicitors, QC's, medical experts and pay all the court fees, a quick estimate would be between £4,000 and £6,000. On top of that in the very liklihood she was to lose, she would also have to pay your costs.

IMO it is extremely unlikely this will go any further and I wouldn't worry about it anymore.
