Email them (never phone) and tell them you dispute owing £160 to Orange Mobile. Once a debt is in dispute Debt Collection Agencies are not allowed to demand payment and have to return the file to their client (Orange).

Orange will not take you to court for such a low amount because of the expense involved and they have no idea if you have the means to pay.

Probably they will give it to another Debt Collection Agency (if they do simply repeat the above) or you will receive a letter from what appears to be a solicitors office, which in reality is a front for the DCA and in any case the same rules apply they cannot demand payment when the debt is in dispute.

After 6 years the debt becomes statute barred which in other words means it is written off.

Mate, they've only got so long to chase you before writing it off. 4 years is over that. Just throw it away.

I work in the finance industry as debt collection manager

They have up to 6 years to chase you & It will be recorded from this period on experian & equifax so this may affect you obtaining credit in the future as it will recorded as a bad debt

Contact Orange, ask them to put you through to their complaints department and ask them why they have not contacted you in relation to this?
Ask for copies of all correspondence that they have sent you in this time. They should have this on record I would also ask them to contcat the the DCA and ask them to put any action on hold in the meantime.

i had a similar problem this week although it's a much smaller debt. i haven't been to DW sports gym in leckwith (by the ground) for 2 months. they wanted money for the month because i didn't give them a calender months notice but july was a 5 week month and technically i did give 4 weeks.
they eventually put my details forward to ARC which is a credit management company who then rung me up and said they wanted £35. you may think i'm being petty but for me to pay £35 when i haven't stepped into the gym for 2 months is ridiculous. they threatened me with court action.

what is a court order?? and wont ely boy get a warning perhaps they wont tell him and just turn up and take his stuff

as mentioned - once the debt is disputed - no one will be knocking your door!

A court order (a type of court ruling) is an official proclamation by a judge (or panel of judges) that defines the legal relationships between the parties to a hearing, a trial, an appeal or other court proceedings. Such ruling requires or authorizes the carrying out of certain steps by one or more parties to a case. A court order must be signed by a judge; some jurisdiction may require it to be notarized.

The content and provisions of a court order depend on the type of proceeding, the phase of the proceedings in which they are issued, and the procedural[1] and evidentiary[2] rules that govern the proceedings.

An order can be as simple as setting a date for trial or as complex as restructuring contractual relationships by and between many corporations in a multi-jurisdictional dispute. It may be a final order (one that concludes the court action), or an interim order (one during the action). Most orders are written, and are signed by the judge. Some orders, however, are spoken orally by the judge in open court, and are only reduced to writing in the transcript of the proceedings.

So, If someone owes a debt of thousands or hundreds of thousands and you don't pay them, then you can get the slate wiped clean after 4/6 years :shock: ...Have I read this right :? ... :ayatollah: :ayatollah:

I had one for some made up amount. If it bollocks then email them and put in the email that you will log any time you spend dealing with this and make a counter claim for time spent etc. Also make sure you email that you dispute the debt and that you are keeping records of emails and letter for citizens advice.

What's the name of the company if you don't mind me asking? Google the company and you will probably find that they have tried it on before and you will get advice to deal with it.

Providing the lender (in this case Orange) hasn't taken legal steps to recover the debt (e.g. A County Court Judgement) then after 6 years the debt becomes 'statute-barred' which means they cannot use the courts to recover the debt.

Whilst the debt may still exist it is effectively 'wiped' out because the lender has no way of recovery.

Small amounts which £160 would easily fit into are never pursued through the courts because of the cost involved and the one fella above who was threatened with court action over £35 is almost laughable. For amounts like that you should always 'dispute' the debt and if threatened with court actions then reply you will happily see them there as you are confident of winning (even if you are not ;) )

However, larger debts (in the tens of thousands) are more likely to be pursued through the courts and if a CCJ is obtained then the 6 year time limit does not apply.

One thing to remember is the start date for the 6 years is from the day you made the last payment. So techically if you make a payment on a debt which has passed the 6 year threshold then the whole 6 year period resets from that date, so be careful if you are thinking of making any payments.
