I've also heard of this... I think they have a 6 week limit of which they must issue the ticket.
But I can't back it up so don't take my word for it... would be interested to find out the truth too

My son got a notice about a month ago that he had been caught doing 33 in a 30 zone, and stated that the offence was in May, so something like 4 months before getting the notice.
He has already paid the £60 fine, and he's getting 3 points on his licence.

Speeding tckts were being discussed today at my wife's school (amongst teachers, not kids!) and someone said that the authorities have to notify you within a few weeks or they can't do anything.

Anyone know if this is true, and if so, can my son do anything about it now that he's already sent the payment and his licence??

Scroll down to the RAC legal help letter on the link and it states that Legally, if the NIC is not recieved within a 14 day period, then prosecution of the alleged offence cannot be followed through..

Martyn, that is at the police officer's discretion... some will put a 10% leeway and then 2 or 3mph on top so you wouldn't get zapped until you were doing 35mph! but that only works for camera vans and hand held cameras. But they can do it at 30mph if there are the usual tw*t type of copper

As i understand it they have 14 days on which to charge you. In your boys case you can argue after the amount of time that has passed it would be impossible to say who was driving. That is why i believe you have the 14 day rule. I think they are putting one over you myself a quick word with citizen advice should clear this matter up. If the Police have broken the rules the fine should be returned to you.
They are sneaky little fuckers but i have never heard of a time delay like that before. It would of been easier had you looked into the legalities before you paid the fine but that is always easy to say. It is defo worth fighting because being a youngster his insurance will go threw the roof.

I have heard of someone getting prosecuted at 32 mph which is petty and a disgrace but they cant do you for 30mph that is the limit. When you are learning they teach you to drive at the limit.

Here is a nailed on way to beat a ticket (if its from a speed camera):

When you recieve notification, write back informing them that you may well
have been the driver, but that your friend (who had taken out his own insurance)
was over from the USA that week, and it may well have been him driving. Ask
them to send the photo for clarification. They wont. They have box after box after
box full of these notices waiting to be actioned... they'll write your one off. Cos
at the end of the day, you might well STILL send it back again saying "wasnt me"

Not worth the hassle for them! :D

I recently had a ticket in the post. They gave me the option of paying the £60 fine and three points or paying £80 to go on a half day course to avoid the points. So I'm going on the course.

Im only doing it because I want to be a copper myself, or work in something along the lines of prison guard or probationary service and its going to be much easier to do that with a clean licence.

That 14 day rule is helpful mind guys. Thanks for the tip, could come in handy in the future. :ayatollah:
