CARDIFF CITY APPEAL Due to start

Thu Mar 03, 2022 11:12 am

Cardiff City's appeal against a transfer ban for failing to pay the first instalment of Emiliano Sala's £15m fee to Nantes is due to begin.

Thursday 3rd March 2022

The appeal hearing is taking place at the Court of Arbitration for Sport in Lausanne.

Argentine striker Sala died in a plane crash over the English channel in January 2019 while travelling from France to join his new club.

An inquest into the death of Sala is ongoing at Dorset Coroners' Court.

French club Nantes and Cardiff have been in dispute over fee payments

Cardiff claimed they were not liable for any of the fee because Sala, 28, was not officially their player when he died and refused to make interim payments as they claimed the deal was not legally binding.

World football's governing body FIFA ruled Cardiff should pay the first instalment of £5.3m to Nantes.

FIFA's players' status committee also imposed a three window transfer ban on the Championship club if they failed to pay.

After FIFA found against them Cardiff appealed to the Court of Arbitration for Sport.

Following a number of delays, the hearing is due to start on Thursday, 3 March and is also scheduled to continue into Friday.

Cardiff are also currently facing two other legal battles.

Former owner Sam Hammam is taking court action over a dispute which is understood to centre around the terms and conditions of a Presidency /Director role at the club which followed the takeover by Malaysian owner Vincent Tan in 2010.

Meanwhile former Cardiff director Michael Isaacs is suing the club and Tan claiming his shareholding has been diluted. Hearings in this case have already taken place

A very big month in the history of Cardiff City FC, whether it be the club directly or its owner

Repercussions good, bad and/or indifferent, will steer the club's direction for seasons to come

Fingers, toes and everything else crossed for a (club) positive outcome :ayatollah:

Chris,

1.The Judge on the Isaac case will be giving his verdict later this month.

I expect Tan to win Isaac case, just hope that includes court costs.

2.The Emilano Sala case worries me big time.
Thankfully Dalman has reassured us that ALL the money is already put aside for this a couple of years ago.
If we win then a lot of spare money.

3.Tan v Sam case, I can see Tan settling and agreeing to pay.

Annis, I tend to agree on all 3 points there, although didn't I read somewhere in the Isaacs summing up that there was some sympathy for his claim of dilution?

Either way, it's small fry in comparison to the other two claims

Sala, for me, could go either way and/or a compromise ordered.

If the politician is right, any judgement against should not impact current finances but a 'win' (horrid term) would surely see additional funds being made available?

With regard to the Sam/Tan case, I really hope that common sense prevails and the two men reach agreement outside the Courts

For me, I think Sam was let down on promises made; I just don't know to what finajcial extent it can be measured to?

Hi Chris,

Yes the Judge did say he had some sympathy with Isaacs losses on the shares, but he would not let him talk about how bad the club was run by Tan.
I 100% expect Isaac to lose, but he might not have to pay Tans costs (Cardiff City's).

Sala could be massive to us, but thankfully all the money they say was and is still put aside if it goeas against us again on the appeal.

I want Sam / Tan to be put to bed once and for all. Sam 100% will win as Tan had signed and agreed everything instead of paying some of the money.

So if we lose the CAS case with Sala, where does it leave us in terms of embargos. If we hand Nantes 15million are we then free sign players. I guess we'd then be gunning for those involved in the travel arrangements?
