in other news the Tories won the election..

its old news, November 4th 2019.

we will only be in a transfer embargo IF we lose at CAS and still do not pay.

Yeah, as Dogfound has said, this isn't really news.

We won't really know what will happen next until the case goes to CAS in the Spring. There's nothing FIFA or anyone else can do until then.

Indeed...and it's unlikely any embargo would take place whilst any related legal wrangling is ongoing

People need to respect that the club (City) are only exercising their legal rights in challenging what they see as an incomplete or even illegal transfer

The problem (for me) is that most of us are very uninformed of the club (City's) legal submissions, yet many have condemned them for looking after their own interests (like none of us would do, of course ;) ) and insisted that City just throw away c.£4m they may not legally owe

Of course, CAS (or now it seems the French Courts) may decide that FC Nantes have done nothing wrong and City must pay up; at which point the people who believe (loose term) that City have no legs to stand on, can gloat that they were right all along even (when they weren't because they didn't actually 'know') at the same time as the club see said c.£14m go out the door

Then again, they just might find City have case...

But hey, it's always worth remembering that opinions are like backsides...everyone has one and they come in different shapes and sizes! :thumbright: :laughing6:

im one of those but I wont be gloating.. because quite simply should we lose and have to pay that money it will have an effect on us going forward. I wish the FAW hadn't received the TMS until the following day.. or it was in some contract that it was Mckays responsibility to arrange that flight... something more than whats out there at the moment..

Of course not, but that's not what happened or even anything close to that.

They bought a player, the deal was completed - he went to say his goodbyes and move his stuff and he was killed in a crash.

I put the exact dates and details in another thread but Igoverner locked it because it showed too much detail. Which is why we now still have threads like this that seem utterly confused by it.

Its all in the 23 page FIFA document, dates, clauses, each clubs arguments and everything you want to know in-between.

FFS Roathie.....give it a rest. I didn't realise you had more inside knowledge than the CCFC legal team, who undoubtely know FACTS that you are not privy to. Please share your boundless knowledge with them and the case is dead!!!

Don't keep spouting what is already in the public forum as I am sure the legal team are aware of those statements, not necessarily facts!

I think a better anology is the roofer finished putting your new roof on but died in a crash on the way home and you refused to pay his widow when you found out the van he crashed in wasn't insured.

There is no such thing as “delivery” with humans. They make their own way there.

However on this occasion he had already been “delivered” hence the photo of him holding the jersey in Cardiff. He then took a personal trip back to France to say his goodbyes and collect some things. The tragedy struck on his way back from saying those goodbyes.

Also worth noting the club did not buy the man, it bought his registration. Otherwise that’s the slave trade. His registration was completed and housed at the FAW as per normal like all other signings. So in that sense it was “delivered” if you want to compare it to a normal non footballing transaction.

You buy a new pair of shoes. You lose them on the way home. Better still you get mugged and they are stolen from you. You can't return the shoes as you don't have them. You could have insured the shoes, you may have bought on a credit card so may have some protection but you wouldn't expect the shop to give you your money back.

There is no CCFC legal team. It’s just Tan. No legal team on the planet would be recommending the arguments that are coming from the club, they make no sense and contradict eachother.

I love the fact I join in the debate, am completely sensible and on topic - yet people say I am derailing the thread :laughing6:

The other thing to consider is that there are other parties involved in this,not just the city and Nantes.All the city need to do is prove due diligence wasn't done.

This sort of thing is happening all the time within the insurance business. Companies not paying out because of "clauses" not met within the small print. Billions of pounds are withheld because of all sorts of reasons.
Because it is high profile and in the public eye, it is going to be scrutinised by the public, who don't have all the facts.
I see our club doing things on a similar basis.
However, I hope we are right in this case, or we are not going to come out of this in a good light.

yes mate ive recovered money for items that have not arrived too.. and had money claimed off me for items ive sent but did not arrive . the later was covered by insurance not by the people that had originally sent the items to me..
sorry but this did not receive the goods analogy doesn't work. there are pictures of him here with our CEO .
you are aware that picture of him holding a shirt was taken at the CCS just after he signed ?
and he was going to France privately and not for anything official to do with football..

All clauses in the contract are public record to do with this deal. I don’t understand what the big mystery is.

Cardiff’s arguments are clear - so is the contract. Which is why they lost, it really isn’t a difficult case.



So all this going to CAS and French authorities is just for show as fifas decision is legal and binding! even if CAS overturned fifas decision it won't matter one jot because roathy says they've lost already ...... :o

And he wants to be taken seriously? We all know fifa didnt look at all the facts just one aspect of deal? What if CAS decides he was not 100% legally ours? It could happen despite our expert knowing differently. :roll:
