It’s the stupid 3 o’clock rule that’s been in effect since the 60’s...

The 3pm 'Blackout'

The reason why you won't see any football broadcast at 3 o'clock on a Saturday afternoon dates back to the 1960s.

Bob Lord, Chairman of Burnley FC, convinced the football league that showing televised games would have impact negatively on his side's attendances and therefore reduce their financial earnings.

Since this time, with the exception of the FA Cup final, between 2.45pm and 5.15pm on a Saturday, no game - whether played domestically or abroad - can be broadcast on television here in the UK.

Changes?

Are the rules and laws passed in the 1960s still relevant today? Would showing a 3 o'clock game really affect attendances? If a football ground can be full at 12:30pm, 5:30pm, 7:30pm then should it not stand to reason that it can be at 3 o'clock?

In 2011, the Premier League went to court in a battle with QC Leisure. They alleged that by supplying pubs across the UK with decoder cards, they were knowingly authorising their ability to infringe on UK copyright law.

Advocate General of the European Court of Justice Juliane Kokott said at the time: "It is, in fact, doubtful whether closed periods are capable of encouraging attendance at matches and participation in matches."

"Both activities have a completely different quality to the following of a live transmission on television."

It was an opinion shared by many - particularly Richard Branson and his company Virgin Media who launched a complaint to Ofcom in 2014 arguing that all 380 Premier League games should be made available to TV viewers.

At the time 41% of games were shown on television (the figure will next season increase to 52%) and their claim was that this number was 'restricting choice for consumers' and encouraging prices to stay 'artificially high'.

After eventually scrapping their two year investigation, Ofcom said: "Due to the range of views expressed in the consumer research, significant further work - including additional research among football fans - would be required to conclude this investigation."

Wider point but I completely agree that games are not broadcast at 3pm on a Saturday. I think it's a stretch that sky do the red button thing midweek which has evidently effected attendances and particularly away travel.
