They're not classed as vermin, all species of gull are protected under the Wildlife and Countryside Act 1981 and the Wildlife (Northern Ireland) Order 1985.

Didnt say kill someone said kicked someone you wouldn't get 12wks for that unless did serious injury ? This particular bird had several things wrong with it not caused by the individual but they decided the kick killed it..
