CARDIFF CITY FC STATEMENT - 25TH FEBRUARY 2019

Club Statement: 25/02/19

"The club acknowledges the publication today by the Air Accident Investigation Branch (AAIB) of their special bulletin on the loss of the Piper Malibu aircraft carrying Emiliano Sala.

We have grave concerns that questions still remain over the validity of the pilot’s licence and rating to undertake such a journey, as identified in the bulletin.

We are also concerned to discover that the trip involved an aircraft which did not conform to either UK CAA or US FAA requirements for commercial activity and therefore may have been operating unlawfully.

We welcome further investigation into the accident, which is required to determine precisely what happened, and to ensure changes are made so that this situation never happens again."

Once again the club are only releasing what needs to be said and this statement goes some way to explaining the delay in payment to FC Nantes

IMHO, the club are right to do investigate the full facts surrounding the whole deal and the circumstances that led to Emiliano Sala's untimely death, along with pilot Dave Ibbotson

The truth will out and only then can people judge... :ayatollah:

The report says that Ibbotson could take passengers if they all payed pro rata (including Ibbotson) for the flight, we know it was stated that Sala didn’t pay, so who did? The McKays? If that’s the case then I’m sorry but Ibbotson was flying without the correct licence and this fact still needs to be confirmed

Absolutely correct in my opinion Chris.
People should calm down now and await the official outcome. This poison talk of ‘foul play’ is pathetic.
The club will do the right thing when everything becomes clear.

Ibbotson didnt pay either. It was reported that he had told Henderson he had lost his credit card. So it looks like all the costs were on Mckay

That’s exactly what I thought, so the question still remains, was Ibbotson flying on the wrong license

Whilst you can claim expenses from passengers to make it a private flight the rules state cannot do so unless its for the purpose with pilot gaining flying hours, obviously this us not case as he was transporting ameliano to get him to cardiff nothing to do with gaining flying time! Only hope the pilot doesnt take the fall for others greed. :roll:

The AAIB report also states very clearly that a “cost sharing” flight cannot be for the purpose of transporting a passenger.

That was obviously the sole reason for this flight!

Totally agree with you on this, Cardiff City will do the right thing as far as payment is concerned but only after we have had full clarity on the whole sad saga. I hear people saying we should do the right thing and pay Nantes the money, do you think Nantes or any other club for that matter start handing over payments without knowing all the facts??? of course they wouldn't, and we are no different.

Taken from the CCA website:

The flight is a cost-shared flight by private individuals.The direct costs of the flight must be shared between all of the occupants of the aircraft, including the pilot, up to a maximum of 6 persons.

So.....

This private flight claim was nonsense from the word go. It was never gona stand scrutiny. There's numerous parties around that flight all of whom would want payment for services / time. There's still plenty to come out as far as the plane accident is concerned and at sometime there will inevitably be criminal charges brought.

The relevance to City is that its likley the flight arrangements were not lawful and so the organisation of that flight is in question. Who organised it, Willie McKay or the Agents McKay and is there any link to the contract. If the agents are found to be acting in respect of this flight and there was no seperate contract to arange the flight then its quite possible that the flight was part of the contract and we shouldn't be paying, not at this stage anyway.

The key as I see it is linkinbg the flight to the agent who acted on the deal and linking the arrngement to the contract.

The counter will be that Willie McKay arranged the flight and was not contractually involved in the deal. Nantes will say they knew nothing of the flight arangement which is probably the case. However if it was financed from the agents cut ( thrown in ) then it may be inadvertantly part of the deal.

The responses above simply re-iterate that it's mainly rumour and conjecture at this moment

With all the newly qualified Barrack Room Lawyers on here, its no wonder the club are staying relatively schtum whilst they fathom it all out! ;)

It also says cannot be done just to transport people to get them from a2b it needs to be to enhance pilots flying time and clearly this journey wasnt for that purpose. :old:

its likely the flight arrangements were not legal. agree

actually proving that when both pilot and passenger are dead is not going to be straight forward.

When I used to fly, it was in a four seater, and the cost was always split equally four ways. That was purely for pleasure, but I would say that this flight could hardly be described as a pleasure flight. Always sounded like a business flight to me, and therefore different rules would apply. No idea what those rules would incur in this day and age, but I should imagine they would be quite rigid, and I would'nt like to begin to guess if rules have been broken, although I have my own personal opinions. Perfectly understandable that the club are being cautious at this stage.
