Advice needed

Due to work lodged in leamington spa week before Christmas on the way to work one morning called into holiday inn and had breakfast paid for by debit card
In the post this morning have had a notice of £100 parking fine
On the morning in question it was pitch black and raining did not see any car parking charges
Do I ignore it advice please fellow bluebirds

If you can prove you were in there and bought breakfast from you're statement I would be shocked if they wouldn't wave the fine mate, they realy wouldn't won't the bad publicity surely.

The IHG hotels all use a contracted-out parking service - each hotel has a policy of charging according to how long you stay and for what reason.

My advice is to speak to the manager ASAP and explain your circumstances.

Cheers mate thinking similar but have read on here not to acknowledge it and they won't be able to enforce it if I contact them with the receipt route that's acknowledging I've had the letter I'm thinking :(

You could contact the hotel by phone (without giving your name) and ask if they have a parking waiver agreement in the first instance? If they do and you can prove you ate there, it shouldn't be a problem

I wouldn't worry too much about the Notice itself, as if looked at carefully you'll find it's actually an unenforceable invoice and not a fine in the true sense (they can only be handed out by proper authorities)

You'll probably get a couple of letters 'chasing' but the worst thing you can do is respond or communicate ;)

Allan you can try contacting the Hotel manager but he will probably refer you back to the Parking management company.

A Parking Management Company relies on Contract Law. They erect signage spelling out the terms and conditions for using the parking service that is provided. If you Park you then technically accept the T&C's and if you breach them they are owed damages.

Firstly the signage has to be clear and precise and lit up if it was dark. If not you have an argument to dispute the 'contract' although you would need evidence of this.

Basically they have sent you an 'invoice' for use of the Parking Space.

Personally I have always ignored them. The Parking Company have no redress but the Courts and they would go bankrupt if they chased everyone who didn't pay that way. They are less likely to pursue you if you make no contact as they don't know your ability to pay or even if you are still alive!

This won't affect your credit rating and even if they did take you to court you could pay up at that point before it went any further. Throw it in the bin and the next few follow up letters.

I had same trouble couple of months back send receipt to parking people recorded delivery and it should be rescinded hope it helps mine was straight away :bluescarf:
