BREAKING ' LEE TOMLIN HAS BEEN SENTENCED TO '

Lee Tomlin pleaded guilty to affray and was sentenced to 80 hours community service and fined.


Lee Tomlin, aged 28, admitted affray.


It emerged from Leicester Crown Court this Friday morning that the former Bristol City, Middlesbrough and Bournemouth forward had been sentenced with 80 hours community service and fined for his part in a nightclub fight that left a man with a badly broken jaw.


CCTV clips presented to the court showed Kee trying to pull Tomlin away from the scene before throwing a single punch towards the victim’s head.




NEIL WARNOCK:

"It’s a relief for him (going back), something like that’s got to be on your mind. We’ve had many chats over the last few weeks. Last time he was in court, it affected him. I haven’t spoken to him since the verdict."

"You’ve got to curb your temper. Yes sometimes the abuse is difficult, but you’ve got to walk away, especially with social media and everyone else."

"Players have got to think twice before they put themselves in a situation where you could go out and put themselves in a situation where you could get into trouble. They’ve got to eliminate themselves from that.”

Hopefully he can stop worrying about that now and can concentrate more on his football, and Neil will feel more comfortable playing him in games with his mind fully on football and not whether he's going to prison, cause he is a quality player and one of our only players who can create chances out of nothing.

Cardiff City star Lee Tomlin ordered to complete community service after early-hours fight left man with broken jaw

Cardiff City star Lee Tomlin has been sentenced to 80 hours of community service for his part in an early-hours brawl which left a man with a badly broken jaw.

Fellow footballer Billy Kee, a forward with League Two side Accrington Stanley, was fined £350 for throwing a punch during the same fight, which was captured on CCTV.

Tomlin, 28, admitted affray after prosecutors decided not to proceed with a wounding charge following a review of footage showing the victim squaring up to the players after jumping over a set of railings.

Leicester Crown Court was told Kee, 26, who pleaded guilty to common assault, attempted to pull his friend Tomlin, who signed for the Bluebirds from Bristol City in the symmer, away from the confrontation in the city centre on January 22.

Both players had been accused of causing grievous bodily harm but were cleared of the charge on the orders of the judge.

Prosecutor Ian Way accepted that the complainant – who spent three days in hospital and had a metal plate inserted to stabilise a displaced jaw fracture – had “contributed” to what happened.

CCTV clips presented to the court showed Kee trying to pull Tomlin away from the scene before throwing a single punch towards the victim’s head.

Tomlin struck out twice at the victim, who had been drinking with a group of friends at the Ghost nightclub, during a subsequent fracas in which a bystander removed his belt, Mr Way said.



Mr Way told the court: “At about 3.30am the complainant and his friend went outside the club to the smoking area, which is near a waist-high set of railings.

“At that point they went over the fence and met face to face with the defendants and their group.

“There was an argument and the next thing (the victim) remembers is a heavy blow.”

Handing Tomlin a 12-month community order and a bill for £500 in prosecution costs, Judge Ebraham Mooncey told the footballers: “The position is that on the night that we are considering both of you had been out for the evening.

“You accept that you were drinking. You (Tomlin) are fearful your drinks may have been interfered with.”



The judge said of the events filmed near and outside the club: “There is conversation taking place and it’s apparent very quickly that it’s not pleasant conversation.

“Both of you don’t appear to be completely sober.”

Kee, whose barrister claimed the player’s actions were “very close” to lawful self-defence, was ordered to pay £150 in costs.

The judge told Kee: “I accept your role was to try to placate matters. Because of the conduct of other people you misbehaved and did throw a punch.”


Former Middlesbrough forward Tomlin, of Broughton Astley, Leicestershire, and Kee, of Mountsorrel, near Leicester, both began their careers in Leicester City’s youth set-up.

Tomlin’s lawyer, Chris Daw QC, said the player had received verbal abuse inside the nightclub.

“He deeply regrets having become involved at all,” the barrister told the court.

“He has learned a very stark lesson.”

Philip Holden, offering mitigation for Kee, said: “He was looking after Mr Tomlin and trying to pull him away from an incident that was developing.

“In interview, he gave an accurate account of what had occurred.”

Tomlins very luck he never got a worse sentence, I think because pleaded guilty to affray and saved a Crown Court Case, he got a lenient sentence.

Generally speaking, it's best to plead guilty in cases like this. Lee Tomlin can put this behind him. He was excellent on Tuesday, and he can concentrate on the football now. Wise words from Neil Warnock, as well.

good news - i hope tomlin learns from this. its obvious a professional footballer will be the subject of wind ups on any alcohol fuelled nights out. players need to rise above it, as warnock states. better still, don't drink at all - wring every last drop out of a career that many would give their left leg for.

Far worse things than this happen outside a club every weekend its because they were footballers that it has gone to court which really is wrong.

If you are getting abused outside a club or pub with a few pints I'm sorry anyone will do what Tomlin did
