Chef Evans has had his rape conviction quashed.

I have been very vocal in my condemnation of having a convicted rapist play football. The conviction was wrongful and as a result, I was wrong.

I apologise without reservation and hope that Ched gets a chance to rebuild his career.

I should have added that he faces a new trial, but as I have stated before: Innocent until proven guilty so this is obviously positive news for Ched and his family.

you put too much faith in the justice system, a guilty verdict doesnt actually mean someone is guilty, same as a not guilty verdict.

this case is almost unique in a way as of the amount of evidence that was public on his site. im inclined to believe him personally, so good luck to him

The footballer, who was given a five-year sentence in 2012 for raping a teenager, may face a re-trial if his appeal is successful.

Footballer Ched Evans will discover today whether his appeal against a rape conviction has been successful.

Last month three appeal court judges reserved judgement after a two-day hearing at the High Court on issues of fresh evidence.

At the hearing the Crown indicated that it would seek a re-trial if Evans' appeal is successful.

Evans was convicted and jailed for five years in May 2012 for raping a 19-year-old woman in Rhyl, north Wales.

He was released on licence in October 2014 having served half his sentence, but his attempts to return to football were accompanied by sustained criticism from politicians, well-known football fans and campaign groups.

Evans protested his innocence from the outset, maintaining that the girl consented to sex.

An initial appeal failed, but following a review by the Criminal Cases Review Commission the case was referred back to the appeal court last year.

He was tried alongside fellow professional footballer Clayton McDonald after the pair admitted to both having sex with the woman in a hotel room.

The woman went to police after waking up alone in the room but did not allege rape, and told the original trial that she had no recollection of events.

The trial jury found that in Evans' case the woman was unable to consent to sex.

McDonald, who currently plays for Worcester City, was acquitted.

The original trial heard that McDonald met the girl in a takeaway after she had spent the evening in a bar after work.

They went back to a Premier Inn where Evans had earlier booked a room, which he claimed was for his friends to stay in, and began to have sex.

On the way to the hotel in a taxi, McDonald texted Evans to say he had "got a bird".

Shortly afterwards Evans arrived, accompanied by a group of friends including his brother.

Evans went in, obtained a key card and walked into the room where McDonald and the woman were having sex. His friends and brother were outside the window, and it is alleged one of them filmed events.

Evans said he asked the woman if he could join in and told the court she consented. He said they then had sex to which she enthusiastically consented. When they had finished he left immediately via the fire exit.

Evans maintained throughout that the girl consented and he was backed by a campaign led by members of his family, which included a website questioning the evidence and the motives of the girl.

The girl, who never alleged rape, was forced to move house several times and change her identity after being named on social media.

Sheffield United's offer to allow him to train with them was withdrawn after objections from celebrity supporters including Jessica Ennis-Hill and the local MP.

When Oldham Athletic tried to sign him last year they were criticised by senior figures including the police and crime commissioner and the shadow sports minister.

Sponsors also threatened to withdraw their support and club officials said they received death threats.

But until the retrial verdict he's now innocent until proven guilty. If indeed there is a retrial.

I hope all the people have stalked ched and done everything they can destroy his and his family life are sorry for they actions. Like willey as been. Especially the organisers of petitions to stop him working after serving a prison sentence. Which he was entitled to do after paying his dues to community even worse now that he is innocent of that charge.

Good luck ched all the. Couldn't we do with a striker like him if he can rediscover his previous ability. ??

Having spent a large part of my life dealing with legal matters I have to say innocent until proven guilty - and that applies to Ched Evans now.

But looking at the larger picture perhaps those in the public arena will appreciate that, whilst they are not necessarily guilty of an offence, they may wish to consider that they could be placing themselves in a vulnerable position and open to question - if they conduct themselves in a manner which maybe frowned upon

I agree. Having read what evidence is available publically I am absolutely stunned that Evans is even within a sniff of a re-trial never mind being found not guilty.

Why an 'innocent' man has to flee a hotel bedroom via the fire escape is a huge contradiction.

As the saying goes 'British justice is the best money can buy' probably sums this whole sicken episode up.

amongst many of Jessica's sponsors is none other than BP, Jessica has no qualms about accepting the sponsorship of a company that the UK government freely admits 'violates human rights.'

Wow there!! I didn't stalk him or campaign. All I did was to express an opinion based on the conviction. I am really sorry that the original verdict was not safe and that is why I apologised. Please don't lump me in the same category as those who sent abusive comments because I didn't. Also notice I was the first to hold my hands up.

Former Sheffield United footballer Ched Evans has won an appeal against his conviction for rape and faces a retrial.

Evans, now 27, spent two-and-a-half years in jail after he was convicted in 2012 of raping a 19-year-old in a hotel in north Wales.

But three appeal judges on Thursday quashed the conviction after fresh evidence emerged. Details can not be reported for legal reasons.

Ahead of the ruling the prosecution had said it would seek an immediate retrial if Evans won his appeal.

Evans made no reaction when the ruling was made but was seen hugging relatives in the corridor outside the courtroom.

Lady Justice Hallett told the court: “On 22 and 23 March we heard argument and we heard the fresh evidence.”

She went on: “In summary, we have concluded that we must allow the appeal and that it is in the interests of justice to order a re-trial.”

Hallett said Evans must be retried on an allegation of rape and be re-arraigned on a fresh indictment within two months.

The former Sheffield United striker and Welsh international was present at the London court with his girlfriend, Natasha Massey.

Sitting at the court of appeal in central London, Hallett, Mr Justice Flaux and Sir David Maddison heard submissions over two days from Kieran Vaughan QC, for Evans, and from Eleanor Laws QC, for the crown.

Outside court after the ruling, Evans’s solicitor, Shaun Draycott, said: “Ched Evans is extremely grateful that the court of appeal has ruled that his conviction for rape was unsafe and should be quashed.”

He thanked his lawyers, family, friends and partner on behalf of his client. “No further statement will be made as it is acknowledged by Mr Evans that the legal process has not reached a final conclusion and there will be further hearings of significance on dates to be fixed in due course.”

Sorry willy think you misunderstood my post or I didn't explain it to well. What I meant is. All the people that thought he was guilty and want him to continue to be punished after he served his time would say sorry. Just as you did. Was trying to use you as a positive example I take my hat of to you for you actions and apology for being wrong.

A question for the legal eagles.

If he's convicted again at his re-trial can he be sentenced again?

Will he have to serve the remainder of his original sentence?

Or will he still be free even if convicted at the re-trial?

Or something else?

looks like he is going to have his rape conviction quashed and hopefully for Ched and his family he will be able to get on with his life.

However, you have to say the facts point to his actions on the night in question as being morally dubious at best..he should never have got himself in that position

Interesting development however retrial may still not go in his favour but suggests the evidence provided is enough to question the facts presented at the original trial

If they did that, the prisons would be full of politicians!!! Fair point.

Any apology will wait until after the retrial. Evans hasn't been proven 'innocent' all that has happened is he has found some evidence which wasn't presented to the jury at the original trial. What this evidence is won't be known until it is presented to a new jury but I suspect it is something which is aimed at blackening the victim's name and making her appear to be an unreliable witness.

Jessica stood by her convictions which were to have no association with a football club which was considering signing a convicted rapist.

Despite what you think Evans has not had the conviction quashed outright. The Crown Prosecution Service and the Appeal Judges believe there is still a realistic possibility of conviction otherwise they would-not have ordered a retrial.

The judges would not quash a conviction just so Ched Evans can blacken her name. It would have to be something more substantial than that. The conviction was unsafe as the jury were not given all the relevant information/evidence.
Blackening her name is easy, she has a reputation of dinking heavy ( she admits so), did not claim rape, had illegal drugs in her system, and tried to financially profit from her claim. Much of tehi was not presented to teh original jury.
There will only be a retrial if he is charged again. They will need new evidence, and have to counter act the defence evidence that the Appeal judges have seen. I doubt there will be a retrial , and they will claim it is to protect the girl, as a cover.

On another point, how was she sober enough for sex with the first footballer, but too drunk to consent to the 2nd one later on? She did not have any more alcohol. The only explanation is that the 2nd one was much more famous and richer.

You have to be proven guilty which is why 3 judges have quashed his last conviction. He is currently an innocent man untill proven otherwise. Just like every other citizen in this country is.

The fact is as it stands he is innocent of his charges. Why you finding the facts so hard to understand??
