CHED LOOKING TO MLS

04/02/16

Convicted rapist Ched Evans wants to resurrect his career in the MLS, according to the Daily Mirror.

The Welsh striker was jailed for five years in April 2012 after being convicted of rape but continues to maintain his innocence.

Evans has tried to find a club in the UK but moves have fallen through due to protests from fans.

It's all gone quiet lately, hasn't it? I thought a decision being "fast tracked" was "imminent" some time ago? :?

The appeal was lodged in October 2015 so any decision this side of Christmas would be considered "fast tracked" in our legal system ;)

Who would he sue? I presume the victim doesn't have that kind of money.

Never mind lost earnings he was put away. If found innocent and that's a huge IF! He can sue for wrongful imprisonment.

Not sure , maybe the courts for wrongful conviction ?

It's very hard to get compensation for wrongful conviction. Evans would have to prove beyond reasonable doubt he did-not commit the crime. Even if he is successful in discrediting the victim and getting the conviction overturned it is hard to see how he could ever prove "beyond reasonable doubt"

Not only that the maximum amount which can be awarded is £500,000 and this can be reduced by taking all of the facts into consideration including Evan's behaviour. At best he has to admit to being unfaithful to his partner by having sex with another woman. Not exactly behaviour which would attract a lot of sympathy.

I believe this would come under what the USA terms as "Moral Turpitude" and then under the section that refers to "Crimes committed against persons, family relationships, and sexual morality (for example, serious assaults, gross indecency, lewdness, kidnapping, contributing to the delinquency of a minor, murder, voluntary manslaughter, rape)."

I also believe an acquittal of the rape charge but guilt on any other sexually related charge would likely result in his being barred from entry under the same rule
