PARKING TICKET

parked in the Asda car park months ago across the stadium and received a ticket from NEW PARKING CAR MANAGEMENT?
I read a few posts and everyone said to ignore it, had a few letters and now had another one which seems to be from a different company again? What should I do?

This is a tricky one. Up until a couple of weeks ago it was believed that these fines were not enforceable, but a recent court case has gone in the parking company's favour(that one was Parking Eye). So you could end up with a county court summons, on the other hand you might be lucky and they wont bother to chase any further.

Had the same from last year,ignored everything until 2 weeks ago.County court summons and fined £200.00.

throw it in the bin. iv had loads from years ago.
next season just type your number plate into casino ipad on entry and it lasts over a year

If you park there again just make sure you get a receipt from asda even if you just buy a can of coke to show you've shopped there

Yes, years ago it wasn't deemed to be enforceable but the laws have changed as the post above.
Bite the bullet & pay it would be my advice.

Well personally i wait wait until a summons from court comes through. Then I would pay it.

I had one through the post and ignored it after they sent solicitor letters etc etc and no come backs. Was the ticket sent to you via post or was it on your car when you returned to it?

DON'T PAY IT!!!

I'm more of a browser on AAMB and read the forum, but now I've felt the urge to help a fellow city fan.

I get a lot of parking tickets to fight due to the location of my flat with freinds staying, I argue it and have never lost!

The new law is correct but he lost the trial because he ignored it if you argue it to POPLA you will be ok.

Contact the parking company and contest the amount of the charge and ask for a reference code to take it to the ombudsman (POPLA)

Then contest your ticket through POPLA and say that the costs are unjustifiable, exaggerated and have no legal standing.

You will win, if you want to PM me I can send you one of my draft email I use.

the parking company are a private company, not the police or council. They have no power to fine/charge you, they can only legally charge you for the cost to park on the property (so cost to asda would have been a few quid).

Due to them always exaggerating the cost, which makes it a fine/penalty, none of the charges are enforceable but you must contest it!!!

Don't ignore it and don't pay it. you must contest it, it will go away then.

I'd imagine there will be a lot online to confirm this for you.

Whether they are enforceable or not is for a court to decide. It's contract law and nothing has really changed in this respect. They are invoices not fines and it's whether you have breached the contract you've entered into by parking there and if so what the level of compensation should be. The parking Cowboys have to decide if the cost of pursuing it through court is worth it for what they will get if a court rules in their favour. You haven't denied them money since it's free. The argument could be you've not shopped there and so have denied the shop some revenue, but if it's a night game and the car park is half empty I wonder if this would count against them?

Wasn't aware of POPLA , could you please send me the email you use as a back up as I tend to ignore the tickets and have got away with it so far - but my luck may soon run out

ps the Court case which has thrown this into doubt is still subject to appeal, so the parking companies might still lose.

Yes it's free for the parking company, there appointed to work on that car park to keep spaces for the shops so people use the shops, it not there costs I'm on about. How they could get you to pay is charging you the cost of parking, Like for example NCP might be £2 an hours, then they can legally charge you £2 an hour for your time there, not £80. Obviously at Asda it's free so I'm not even sure if they could argue a nominal fee.
