ANY LEGAL EAGLES ON HERE ?

Im sure you all know or heard about the death of the Filipino nurse in the UHW yesterday morning .

As some of you may know ,my wife is filipino and they are a close nit people. I want to know as he was on the Hospital grounds and going into work ,would he be covered by there insurance, As he has no one here and most of his family is back in the Philippines . He like many other filipinos Im sure was supporting his family back in that country ,and as you know there not a wealth people.

We the FCIC Filipino community In Cardiff are now trying to raise money for his funeral and to send his ashes back to his love one.

I want to know how he would stand as to help from his employers The UHW and any benefits of the state he would be entitled to. If anyone know how he stand Legally please help . I am surprised no one has answered your question. This is only my personal take on it, but working on NHS property would be classed as an industrial accident, was the nurse leaving work? or was he still on shift, the Health and Safety Executive (HSE) would be called in. Pay/holiday pay would be paid to the next of kin. If you think that the hospital is at fault, then a solicitor/lawyer needs to be consulted. Sorry if I cannot help more

I'm sure the RCN or UNISON would be able to advise on the matter.

I have not seen the story so do not have any facts. Generally to recover compensation you need to find fault on the part of another. Death in employment of say natural causes would not come within that definition.

If the death was work related in any way then you should consult your Union (I represent RCN members in South Wales) but if no membership you should certainly consult a solicitor. I would be happy to chat without charge to investigate, explain and help if I can.

Happened just before I got there right outside a&e It happened on the rd, having worked NHS 25yrs I suspect no he isn't covered by nhs ins as 1, he was not in work 2, its classed as public rd, 3 he was hit by a 3636 del lorry so have to claim from them if at fault! Lastly if paying NHS pension spouse or nominated person will receive in service death benefit. :thumbup:
