Malky Mackay and Iain Moody could escape punishment for their alleged “sexist, racist and homophobic” text messages thanks to the Football Association’s refusal to act over private correspondence.
The FA was on Thursday looking into texts sent by Mackay and Moody during their time at Cardiff City, who reported their former manager and head of recruitment for alleged misconduct in an exhaustive dossier compiled by chairman Vincent Tan.
The document is believed to include details of their transfer dealings and thousands of texts and emails, some of which are explicit and offensive, including one about South Korean international Kim Bo-Kyung which refers to him as a “fkn chinky”.
But Mackay and Moody, who is on the verge of leaving Crystal Palace following the revelations, look set to avoid any FA action over the discriminatory messages unless it can be shown they were disseminated more widely.
There is nothing in the FA’s rules on discrimination exempting private correspondence but it has controversially adopted a policy of not prosecuting such cases.

That policy helped Richard Scudamore avoid a charge at the end of last season over sexist e-mails exchanged by the Premier League chief executive.
Paul Elliott, who recently rejoined the FA as a member of its Inclusion Advisory Board, was also never formally charged last year over an abusive text he sent to fellow former player Richard Rufus containing the n-word.
Elliott did, however, resign from his FA roles after his position was described by then chairman David Bernstein as “untenable”.
Mackay and Moody also look unlikely to face any police action over the discriminatory messages unless one of their alleged victims makes a formal complaint.
Yet, Tan’s dossier contains other allegations relating to their time at Cardiff which were also being examined by the FA on Thursday.

This seems par for the course when football investigates racism, I suppose his resignation from our club could be deemed punishment enough for using a company phone.
I think there should be an investigation by the police, why should a footballer of ethnicity or gay risk their career by reporting the incident to police as an individual. What give Malky the confident to text what he did ? will we have a similar police investigation to operation yew tree, when all the racist protagonist are no longer in football ?

Malky will never have a top level job now no matter what. Scottish second division or the Irish League maybe. Sad end but if he's done what is alleged he deserves no better, and if he has ripped of the club I want him jailed.

I agree, according to press reports this is "currently" under investigation and given the nature of the subject and the publicity I very much doubt they will let them both slip away through the net, after all if a city supporter gets caught chanting racial remarks it's a lifetime ban so whats the difference between a manager racially abusing his team members?

there is no direct complaint from a player though.......and football fans are treated totally different to any other situation...no charge /no police doesnt mean not guilty....

So that makes it ok? Lets se what unravels over the next few days.

The above post said Malky might manage in a lower Scottish or Irish league 1 day. That may be true, but I reckon he'll be presenting a Talksport show soon-AKA Andy Gray! Think back to some of the things him and Richard Keys were saying, and look what happened to them!
