Drivers on phone penalty 'may double'
A driver who killed a man soon after using two phones to send texts and make calls has been jailed for six years.
Sukhdeep Singh Johal, 27, of Leicester, died on the A47 near Wisbech in Cambridgeshire on 15 March last year.
Marina Usaceva, 31, of Peterborough, ploughed her Jaguar into the back of Mr Johal's Peugeot.
Peterborough Crown Court heard she denied she had been using a mobile phone when questioned at the scene but inquiries revealed this was not true.
In fact, Usaceva, of Padholme Road, had sent and received texts and calls on two separate mobiles in the 20 minutes before the crash, which happened at about 16:30 GMT.
'Plague on society'
Prosecuting, Georgina Gibbs told the court: "When she was told that two mobile phones had been found to be used on this occasion, she continued to deny it."
Usaceva had been caught using her phone behind the wheel on two previous occasions and her licence was endorsed in 2009 and 2012, the court heard.
Mitigating for her, Ian Brownhill said: "There is a gap of six minutes - I would say clear water - between using the phones and the accident itself."
He also told the court Usaceva was the sole carer of her eight-year-old son, and called for the judge to consider the child's welfare.
Sentencing Usaceva, Judge Sean Enright said: "If you were not sending texts at the time, then you were fiddling with your phone and that is what caused this collision.
"In my opinion there is not a scrap of remorse.
"Mobile phone use while driving is a plague on our society," he added.
Usaceva, who admitted causing death by dangerous driving at a previous hearing, was also banned from driving for eight years.

I think its right to take a hard line on this. Even if you cant prove you used a phone at the time of the accident you should have the book thrown at you for using it on the journey. Otherwise its like saying its ok to drink drive as long as you don't hit anyone and it sends out a message that will save lives.
I think drivers should be forced to put mobiles in the boot before a journey. I see some idiot driving with a phone in their hand quite often, with a it wont happen to me attitude. I hope they read this and take note!

Most of us probably see this everyday and it drives me wild. Twice yesterday, a bloke on his way home from work who just couldn't resist the urge to text undoubtedly trivial bollox and then a woman who just couldn't help herself driving out of a supermarket with the phone jammed between her cheek and shoulder. I'd jam the fecking thing right up her fat arse. I reckon that as more vehicles have cameras on board that it will lead to these tossers going hands free.
