I posted on here a few days ago with a Cardiff top i made for myself! I have been asked by a lot of people if would make them for them to buy, and I might be considering on making them if interest is good!
Problem is the badge i used is the badge that was used before the Tan rebrand, and was wondering if i would get into trouble if i was to use it? So the question is, does the badge still belong to Cardiff City, and would it be illegal for me to use it?

I am sure people have sewed on that badge onto their kit or something, might be wrong.

Those other people haven't then used that badge to sell on at item.
I'd steer clear Cal. I believe they still own the rights to it. Even if they didn't, I'd steer clear to be honest.

yeah that's what i'm thinking! it might not be used, but it still can be owned!

The Bluebird used in the badge is Under Trademark of CCFC ltd, as is the badge so I'd steer away from anything that you may be looking to make with our bluebird on. Kind of the reason why the. Trust have made their own shirt with their badge on as it doesn't use the current bluebird.

It really is a nice shirt. Scuse me if I'm being overdramatic here but do the club have any rights to refuse entry with anyone wearing the shirt? As it's their trademark or report them on the spot? That's why I've always wondered why scarfs outside the club etc don't have the official logo

You'd be ok doing it for yourself, your problem would come if you did it as a commercial venture. That's my concern with the other shirt. The Trust are ok as they're using their own branding.

Personally the only reason I'll be purchasing an alternative kit is for the Ty hafan donation.
I know I could buy another alternative kit and just make a donation to them myself but I give regular anyway, but obviously the more that are bought means the more that is donated and this is good due to the positive publicity it creates so it's a 3 in 1 bonus.
I think your top would look better using something other than a branded top too, not fussed on it with the Adidas (only my opinion obviously)

It all hinges with whether Cardiff City have REGISTERED with the Intellcectual Property Office under the Trade Marks Act the, Badge with which you intend to trade on the open Market. If they do and, they believe that there is an infringement of their Intellectual Property Rights then, there is a realisation that Proceedings could be sought to stop your item being used as merchandise. If not, then you have a legal right to trade your merchandise to anyone and, no one can prohibit your legal right to trade the said item.
You can check with an enquiry to the Intellectual Property Office if, this is the case. It is a nice item i'll give you that. Be a shame if it was a "Protected property", as it looks good!

yeah going to stay away from using the original badge, going to design another one! what would you knoe on using the bluebird? BU and other people have used it for merchandise, would there be a problem using that?
