O/T False Claims

I was wondering if someone in the know could answer this.

I had an accident in May 2009 where I bumped into a wall, it was an old wall with a few cracks in it and there was no damage whatsoever from me bumping into it. I'd driven past the wall most days and know the cracks were from before as they had big conifer tree hedges. The person whose wall it was it was claimed against my insurance which, although I know the wall damage were old cracks, is fair enough as I did bump into their wall. I don't know the exact figure but they claimed around £1000 or something off memory, yet 4 and a half years later and the wall is exactly the same. It has had no work done to it whatsoever and even though it was my fault, it kind of annoys me that they claimed all that yet haven't done anything to it.

Does that make it a false claim?

possibly but let your insurance company deal with it its there money at the end of the day. there not obligated to fix the wall they can do what they want with the money.

Yeah it was all dealt with and stuff, but I thought when they claim they have to give a quote/ estimate as to the damage to e.g. the wall in this case in order for them to get it repaired, meaning they have to get it repaired?

I don't know, like I say it was my fault anyway, just its frustrating that for some insurance companies (not all) they look back 5 years for history of accidents and having to drive past it and see nothing done to it when they claimed so much money against me when I know for a fact it wasn't me bumping it to cause any damage at all is just annoying :lol:

If your insurance company offered a "one off" payment then I doubt it is a false claim, as they can do what they like with the cash. However, if they had presented receipts for materials and work done, then yes, it would be a false claim.

Contact your insurers, they should tell you everything about a claim against you.

dont worry about it, they dont have to repair the wall just get a quote for the repair and then the insurance company pays that ammount. If you think the claim was false tell your insurance company they will investigate. They havent taken any money off you its the insurance company that will lose out

I think they provided/ got an estimate or something from a builder but that's it. Must be the one off payment you suggested but I'll give the insurers a call tomorrow and see what they say. Thanks for clarifying :ayatollah:

I did something similar with my conservatory roof, had some solar panels and the fitters dropped to lit cigarettes on the roof which made 2 slight burn marks. I claimed on there insurance and 3 mates in the building trade gave me 3 quotes for replacing panels etc. we then had a night out on half the cash.

I'd file a counter-claim for whiplash as a result of inadaquate-wall bumpage and brick crack-a-lacka.

Its fair to say though that should that wall subsequently fall over and injure or kill someone the owners may be criminally liable after leaving that wall in an unrepaired condition with the money claimed on your policy.Just a thought.
