Is another 5 million really due to Sam now?

There's been a lot of talk about Sam being owed another 5 million now that we've been promoted.

I fully accept that there may be a clause in the contract with Langston that says that, but would that clause been enforceable if it was litigated by Sam?

Given that I think its going to be hard for Sam to claim that he was not an integral part of Langston (and he was clearly the main player in CCFC at the time that contract was made), I have my doubts as to whether or not that clause would be deemed reasonable and proportionate, given the circumstances around how it was made, if the case was litigated.

I have no inside knowledge at all around this issue, but it would be very interesting to see what the Court would make of it if Sam decided to litigate - Personally, I think it may not go the way that Sam wanted, but we won't know for certain unless it is litigated.

I personally hope a reasonable compromise is found between Sam and VT and the whole Langston thing can be put to bed once and for all this summer. :ayatollah:

Dai, All I will say is Tan has signed and agreed there would be £5mill owing to Langston if we were promoted before he took control of our club.

Possibly part of the reason why there have been no major negotiations going on over the past few months. Sam waiting to see if we got promoted. Would be silly for him to reach an agreement until he knew whether we were promoted or not.

When money is involved Sam only cares about one thing .....Sam, err I mean Langston.

I bet he was smiling on Tuesday but that it had little to do with his professed "love" for his " family" at Cardiff City!

What I personally would like to see would be a sensible agreement made between VT and Sam which would be fair all around - clearly Sam is owed something, but the precise details of what is appropriate may be subject to complex litigation unless a sensible compromise is found.

I would be highly suspicious of such claims of agreements having been signed and being enforceable unless I saw them myself and was able to sit down and analyse the small print very closely - I'm not disputing what you say is true at all (I accept your word on the issue), but the devil is always in the detail in these kind of contractual issues.

I would love to see Sam convert whatever he is ultimately owed to equity, along with all VT's loans being turned to equity :ayatollah:

Now that we have been promoted, Sam is entitled to an EXTRA 5 million on top,of what he's already owed.

When Langston renegotiated the debt from £24m + interest to £15m plus interest and £9m for stadium naming rights it was written into that agreement that the "quid pro quo" for that concession was a one off £5m payment should Cardiff get promoted to the Premier League. In the court case back in 2008 that was accepted by all parties to the agreement.

Although there have been a number of attempts to renegotiate the terms one constant in ALL agreements has been the £5m one off payment if Cardiff won promotion.

No doubt in my mind that after last Tuesday evening the Langston debt increased by £5m.

Fair enough and I know he can't name a price but just see him asking for a bit more that's all.

As you say the £5m promotion payment has remained a constant thing.

It does make you wonder if VT will really settle the Langston debt. If he is keen to do it, why wait until an extra £5m is owed to Langston? I really think it will go on to 2016 and VT probably won't be here then.

OK Castleblue, that's almost certainly correct and I fully accepted what Annis was saying earlier, and I'm not disputing at all that it's within the contract, but what I was wondering was whether or not it would be deemed a reasonable term of the contract if Sam decided to litigate it.

I haven't read the judgment from the court case a few years ago, so it may be dealt with in detail there, but I suspect it may not be as simple as Sam would like.

What everyone is forgetting is that, that the Judgements means nothing anymore as a new deal/contract was written between Langston and Peter Ridsdale and was accepted by the Malaysians, through Alan Whitley. 100% Fact.
I am trying to stay out of this as I am still on cloud nine after going to Burnley and this just causes more arguments.
