Q, do i have the right to defend myself?

Tue Feb 12, 2013 3:30 pm

If you genuinely believe you are about to be attacked, you are well within your rights to strike preemptively (i.e. first,) using reasonable force to eliminate the threat.

Reasonable force is judged by you at the time, but you would have to be able to demonstrate afterward to police/jury that it was justified and not excessive.

E.g if someone was coming at you with a sword and shouted "I'm going to cut your head off," and you managed to pick up a brick that just happened to be on the road, swung it at their head once, knocking them out, before fleeing, then even if they happened to die as a result of the injury, that could be deemed reasonable force and you'd face no legal repercussions.

If the same thing happened, but after knocking the guy out, you then proceeded to smash his head to pieces with repeated strikes of the brick, that is clearly excessive and not necessary force to eliminate a threat to yourself, so you could easily end up in jail.

Main points:
If possible, avoid trouble at all costs.
If you do genuinely feel you are going to be attacked, react first, hit hard, fast and aggressively till the threat is subdued, then flee. (Action is quicker than reaction, "better to be judged by 12 than carried by 6
More often than not, it is what you say to the police AFTER an incident that lands you in bother.
Don't give a statement without speaking to a lawyer if you're uncertain. You're well within your rights to do so.

the way this government , justice system and PC bragade are run, if someone comes at you with a sword yelling "ill cut you up" etc, your supposed to just stand there and take it! no buts!

lets face it, you'd be in more trouble than them, if you hit them or tried to defend yourself , fecking country

Back when i was in a security team we were always told u can strike first if 'u felt in danger' and the police would accept that reasoning... Same if someone had a weapon, someone i knew bottled someone that was swinging a chair around and the police let them.off as it was deamed reasonable force

Even if you aint within yor right in the eyes of the law, still defend yorself. Then shut yor mouth in the police interview room and let them prove it. most of the time, ppl get themselves convicted of assault etc because they don't know when to shut there mouths and end up hanging themselves. Get yourself a good brief and let him deal with it. Police-C.I.D are trained to catch you out in interviews, I've always found the best policy is to say fukall, even if you think you've got a good excuse, still say fukall, then build yor case over the coming weeks, months or how ever long it takes for yor case to go to court, give yorself time to get yor story straight with other parties. That policy has stood me in good stead Lol

Dont forget the bill that the council will send your family for them clearing up the mess of your head on the floor after it had been chopped off.
