Employee hours contract law

I know this is a bit off topic, but does anybody know much about an employee being forced to reduce hours ?

My girlfriend has a 30 hour contract. Today she was told that the company no longer wants 30hour contracts and to change that to 20 hours .

have to give her written notice for it to stand leaglly i believe but can do it, you can ring acas in cardiff they will tell you

Do you know how much time they have to give? She is currently 17 Weeks pregnant so it will not matter once Maternity kicks in. We could really do without a 33% reduction in her wages at the moment.

It is hard to advise without seeing the contract of employment.

If I were you I would check it carefully. Look to see what exactly the working week is for example does it say the working week will be 30 hours or is it a lesser figure along with a sub clause that the company expect you to do a reansonable amount of overtime?

Also look for any clauses that give the company the right to vary working hours provided they give notice.

If after checking you are sure your Girlfriends hours are 30 and no clauses to vary this exist then your Girlfriend's employer would probably be in breach of contract.

She should get advice from the Citizens Advice urgently and not agree to any changes until she does.

Contact ACAS immeadately. This happens very often to pregnant women and it can be automatic sex discrimination.

Her handbook states

"If we need to alter your contracted hours because of changes in our business needs, we will not do so without consulting you to make sure we come up with a plan we're both happy with"

all she has to do is say shes not happy with the plan

Looks as though you have a good case bartley.

The consulation process is around a month, that's after the company has given notice of their intentions. As she's pregnant you may well have a case for constructive dismissal, the law is very much on your side here. As others have said get in contact with CAB as they can refer you to specialist legal advice. One tip, write everything down with dates, times, names of people spoken to, etc. One thing to check as I'm not sure is whether 30 hours is regarded as "permanent full time employment" that can influence matters but if she's made them aware that she's with child before this came up then its back to constructive dismissal.

You def need to take advice with this issue also citezens advice - I have heard of many woman having "contracts" changed all of a sudden
