NANTES BEING PAID ON WEDNESDAY

Here is how it may work out - we pay Nantes to get the embargo lifted.
We counter sue Nantes as Mackay - acting on their behalf then organised the illegal flight.
We will sue for loss of earnings that Sala would have brought to the club (Cardiff).

Nantes will realise the payment is an empty victory as the majority of it will be coming back to us (Cardiff).

Settlement out of court, Mackay and many others will be counted sued both by Nantes and us both in the UK and in France.

Mackay (so I heard) has declared bankruptcy and any assets were transferred to his wife a long time ago. Both clubs will go after him personally (not sure if that wil work out if he was operating via his company - but this would come under French law as Mackay was representing Nantes.

A unique set of parameters here and interesting from a legal perspective.

So - in legal terms whether they knew it or not , Mackay was working for Nantes. Hence why I believe - as soon as the money is paid the club will counter sue for loss of earnings with regards to what they allowed to Mackay to do.

It will be a pyrrhic victory ( a victory with no winner). The fact Mackay maybe skint or not, will not be relevant in the subsequent counter claim against Nante. There will court action against anyone involved in the chain that has money.

I think personally Dalman knows this. But it would be remise of him to mention it in public, you save that for legal papers and the court room.

Plus after the deal with Nantes was done , it was up to Sala what he did in his own tone and he went back to France to say goodbye to his friends and put his dog teddy to fly over here, at that stage Sala was a registered Cardiff City player.


But this is not what we are currently fighting, our Regine is fighting that they are saying he was not our player and he was and so have 3 different Courts confirmed that , surely that is it with that, now using £20million.

As I see it Annis they don’t need to be interested in the individual’s assets or whether they’re alive.
Potentially sue any/all of the following

Mckays PI insurers-even if they’ve shut the business down their PI would have run off cover in place for a few years
Henderson’s insurers- if he had any, similar run off cover
The plane owners insurers-same.
Nantes-who are tied in as per the vicarious liability they should have via the Mckays. I think strict liability may apply on this under EU law. Which I think would make it difficult for Nantes to hide behind cross border legalities.

This assumes the various insurance policies for the small businesses were not invalidated by the illegal use/hire of the plane. I’d say Paul Keevil could answer that.

I don’t think CCFC could have previously brought claims against any of the above until it was legally proven ES is/was our player. Because the insurers could have dismissed the claims by saying Cardiff haven’t yet suffered a loss due to ES’s death as he wasn’t ours to lose. If that reads how I intended!
Either way, we’d all love for this to be over. For everyone’s benefit. But it may just be moving into a new phase.

It's common knowledge, his letter to sala was published he was the selling agent for Nantes link is there.
