Don't be so silly. It's the law to give a fair and accurate reference but it doesn't have to be a good reference. What would be the point in a reference at all if it was just going to be good ?

Surely if whatever happens is that bad as a responsible employer you have a duty to inform any other future employers of that? Isn't that what a reference check is....

There is a difference between a bad reference and someone who has been naughty as you should know in your business. I have done recruitment and we dismissed someone for a 'bad' reference because they lied and had been naughty in their last employment.
If you read the amount I was responding to rather than constantly trying to pick an argument maybe you will understand why I used the word 'reference' because the person who made the comment I responded too used the words 'work reference'..

It's fact, you cannot give a directly bad reference. That's why many of the larger firms now will just give you a standard written reference with the name changed at the top.

I honestly wasn't trying to pick an argument but your comment that giving a bad reference is against the law isn't factually correct that's all. An employer is entitled to tell the truth, if someone had been naughty they can state they were dismissed or if under investigation they can state that, however they can NOT disclose the exact details of the incident. Why Tan didn't submit the dossier earlier is beyond me but it does seem that this is certainly driven by Tan's pride and nothing else.
