The things you are talking about are called restrictive covenants and judges are reluctant to enforce them due to the conflict with the "right to work" act.

If the employer has breached the contract of employment (which Malky claimed as he was going to court) the covenant is deemed null and void, so it would not have stopped Malky getting another job.......unless his case for unfair dismissal wasn't actually that unfair.

That means he has had a big payout and is basically saying sorry to those who called him Milky. In other words he is taking the piss but some cant see that specially Tan.
