I'm sorry put if you play football for a living there is a VERY high chance you will get injured at some point, it's part of the job. I seriously hope he looses this case or we will have a court case every time a player gets injured.

Agreed. I think cases should be introduced for when an unfit club player gets called up to his national team and the national team manager has no consideration for the player or the players club and still decides to play the player, resulting in the player returning back to his club in a lot worse shape or even further injured. It happened to me on FM14 and I was fuming.

Looks to be unlucky there, DB pokes the ball away as Oli goes in to tackle, cant see no malice or loss of control there.

A couple of very interesting points have been raised here and, whilst I share the majority view, that footballers know the risk I will try to put the legal spin on it.
One very good question was "Can Cardiff City be sued?" The answer to this is yes. By way of an example lets assume we were driving a work vehicle and collided with the rear of another car. The proceedings would be served as blaming the Defendants Employee, Servant or Agent. I guess this is what has happened here.
In Court the Claimant will need to prove Negligence and prove Quantum (the value of the claim).
In the same way as some of us have mishaps with our cars - none of us truly go out to have collisions Right?? - then Seyi didnt go out to cause injury to Dexter Blackstock. Nonetheless his tackle could be construed as negligent and, in my opinion, probably will.
Any losses suffered as a result of this (Quantum) will then be considered. This could include Medical Bills, Loss of Earnings, Loss of bonuses and the injury itself.
Over the years I have dealt with Personal Injury claims for various footballers - resultant from Road Accidents.
I remember one particular Premiership player who was paid £3250 for his Whiplash injury but received close on £100k in respect to lost earnings (bonuses)
Cardiff City need not worry. There insurers will pay out - Provided we were insured at the time!

Don't worry, if he wins I'm sure he'll be blacklisted and never play for another club

only cos hes done his bollucks on betting. hes getting done by the FA over gambling in football bbc reports today
