FIRST REMEMBER EMILIANO SALA LOST HIS LIFE AND HIS PARENTS LOST A SON :cry:

IN JUST OVER 2 WEEKS:

The court verdict on CCFC’s court case against Nantes …..is due on Monday 30th March (on the last account).

I remind you that we are asking €120 million ….or £104 million .


I really hope that Tan succeeds with this court case as it will relieve a lot of the financial pressure of his shoulders as he’s been struggling in his own businesses and their has been No money for Cardiff City and this may make him spend some money on us .

Remember Tan has lost Case after Case Costing Cardiff Beyond £Millions.

And Remember this is a Civil Case brought by Tan as he’s lost through all the European Court Cases etc etc.

What do I know ?

And I can not really give a proper fully view …..

But personally I believe that yet again Tan will lose this court case .



My reasoning is - because our whole case is based on McKay was acting on behalf of Nantes ….when he arranged the travel ….and because he was negligent …..Nantes are responsible .


To start with ….this logic is debatable , secondly Nantes deny that he was acting for them , third (and that is where I have my real doubt) …..what was McKay acting as ? ….as agent to conclude the Dala signing deal ……well the deal was completed !


So after that McKay could not possibly have been acting for them …..he was finished with his job for them .

Sala was our player . If Sala reached out to him to arrange the travel ….then this has nothing to do with Nantes …..Sala was reaching out to someone he knew and who had arranged those similar flights before .

Flights that Warnock and other Club staff had used . Moreover , McKay (I hear) was close to Warnock . Furthermore , Sala was texting with McKay’s son (who was a CCFC employee at the time) .


Look , I clearly do not know …..and do not know the intricacies of the legal case and quite likely what I am saying may be wide of the mark ……but I thought I will put it out to the fans for discussion and anticipation as to the verdict of this very important event.


Tan is very litigious ….he goes to court at a drop of hat. He loses very decisively almost all his court cases .

Remember Neil Warnock used the same flight company and the Staff at CCFC

Warnock had Mckays Sons playing for Cardiff City’s U21’S
Both were very good friends

It’s going to be a sad day no matter what the outcome because a young man (and the pilot) lost his life due to the nefarious actions of others! :cry:

I don’t think anyone can be ‘confident’ of the outcome (French Law is different to our own) and there may well be further delays, so it’s difficult to speculate

With that in mind, I’m just going to wait for the outcome and hope that Emiliano Sala can finally be left to lay in peace! :ayatollah:

Could Nantes appeal the appeal? What are the chances of them paying anyway? How much money do they have? How could it be enforced?

But I hope we get something; after all, if we win, we will be proved right.

Neil,

As you know I love Dogs more than Humans and I’m with you on this it breaks my heart that photo and their is another photo showing his dog still waiting for Sala to come home :( :(

Yes because they’ve never appealed anything.
But as it’s a Civil Claim, it would Cost them a fortune.

Sven. My understanding is this case is brought on the basis of Vicarious Liability under the Law of Agency. One of the oldest national and international laws in the world. From memory France apply this law even more stringently than the UK does. And I believe Nantes has previously been prosecuted for irregularities relating to agents employed. I think it may have been for using an unregistered agent. For me it’s always been as a result of McKays actions. He should not have overridden the travel arrangements the club put in place for ES.

Let’s hope it is finally brought to rest and everyone can move on. RIP Emilio

I think he has more chance of winning than most do, although he won't get the full amount I doubt.

He's wasted millions on court cases but I actually think there is reason behind this one. Nantes' reputation of alleged corruption will go against them.


As for Warnock, I've expressed concerns about his dealings for years. Many people said I had a vendetta against him but his agent relationships and what that meant were always a massive problem.

That is why I will never ever look at his time at the club favourably, regardless of achievements on the pitch.

He won't get anywhere near what's he's asking for but would be surprised if we didn't get the transfer fee back

Hope Tan/ Cardiff gets the lottery, put it to what the club owes Tan, this would make us more attractive to a good buyer for the club.

It will be good to bring an end to this for Emiliano's family but I think this is pretty much the end game now.

I've said all along that City had to push this to every level of the arbitration possible to them, simply because every single stage has added weight to the argument that would be made in the civil court.

Nantes by defending themselves in all the arbitration courts have now confirmed the following in a legal setting.

1) Emiliano was 100% our player.
2) The contract that was in place was binding (hence why we had to pay)
3) Mackay was involved in the deal despite being struck off.
4) Mackay was acting on behalf of the selling club (Nantes) and initiated the contact (this was in the out of court settlement between Mackay and CCFC
5) Cardiff offered Emiliano business class flight from Nantes to Cardiff - it was the agent (Macaky) acting as Nantes intermediary that offered him the option of a private flight
6) This was not authorised by CCFC it was authorised by the agent acting on behalf of Nantes.
7) The agent arranged a flight with an unqualified pilot and an uncertified plane.

A spaingful as it has been all of this is now explictly acknowledged in formal legal documents. Each round of litigation solidifying the documentation of the further. All of the above is now accepted as fact.

Therefore, CCFC's case, whicv is to establish that Nantes acted in a negligent way in relation to the transfer of the asset (I hate to use such non-humanising language but that is the way it will be presented legally) was incomplete.

The result of that negligence financially is:

a) direct loss (cost of transfer)
b) potential loss - cost of not staying in the league
c) legal cost
d) reputational damage.

Personally I think we over-egged the potential loss, understated the reputational damage - but honestly I think it is a case of how much the court will award us, rather than if we will win at this point. I may well be wrong but Nantes seem to be backed in the corner at this point.

I just don’t see how it can be 100% that we would have stayed up if Sala made it over here

I'll admit I don't know much about the court of law but that will get ruled out as speculation surely?

They use experts who give a percentage chance and then they use that.

We were close to staying up that year, so the chances of a ‘proper’ striker calculated as ‘making the difference’ of even just a few points, has to be in our favour! :ayatollah:

Interesting that most people in their replies aren't referring to what it says in the OP about the agent's link with Warnock.

Maybe because they don't want to accept that, especially as some of us have been saying it for years but were accused of just having a vendetta against Warnock.

I don't know if this is the reason why, but I do know that Tan won't have Warnock anywhere near the club again while he's owner - one of the few things I agree with Tan on.
