FIFA Ordered Cardiff To Pay Up £5.3 Million / The first instalment of The Transfer Of Emiliano Sala

viewtopic.php?f=2&t=210175

BBC Sport has learned that the second instalment of the £15m fee agreed for Sala is due to be paid in January 2020.

The BBC sport website is suggesting we’ll owe the full amount and that it’s just the first instalment that’s due at this stage?

Cardiff City have been told to pay the first instalment of 6m euros (£5.3m) to Nantes for £15m striker Emiliano Sala.

BBC

Fifa ruled Cardiff must pay the sum "corresponding to the first instalment due" in the transfer agreement.

The Argentine, who was 28, died in a plane crash in January while travelling from France to join his new club.

Cardiff have argued they were not liable for any of the full £15m fee because Sala was not officially their player when he died.

The club refused to make interim payments, claiming the deal was not legally binding.

BBC Sport has learned that the second instalment of the £15m fee agreed for Sala is due to be paid in January 2020.

Cardiff believe the transfer was null and void because Cardiff said the Premier League had rejected certain clauses requested by Nantes in the original contract and that Sala never had a chance to review or sign the final version, meaning their record signing was not registered as a Premier League player.

Ligue 1 club Nantes claim the required paperwork was completed.

Cardiff City have been told to pay a transfer fee of 6m euros (£5.3m) to Nantes for Emiliano Sala.

The Bluebirds had argued they could not be held liable for the £15million fee because Sala had not registered as a Premier League player.

But FIFA's player status committee has decided that they must pay the amount equivalent to the first instalment of that fee as he was actually signed.

The next step means that now a decision has been delivered, both clubs have a period of 10 days in which they can request a copy of the grounds which led to the decision and sum owed.

If either party is unhappy then an appeal can be lodged and the case will go to the Court of Arbitration for Sport in Lausanne.

The Argentinian died when the aircraft he was travelling in from France to the UK to complete his move to the Welsh side crashed in the English Channel.

The Bluebirds had argued that they could not be held liable for the £15m fee because Sala had not registered as a Premier League player. But Fifa’s player status committee has decided that they must pay the amount equivalent to the first instalment of that fee.

A statement from the committee read: “In a meeting held on September 25, 2019, the FIFA players’ status committee established that Cardiff must pay Nantes the sum of 6,000,000 euros, corresponding to the first instalment due in accordance with the transfer agreement concluded between the parties on January 19, 2019 for the transfer of the late Emiliano Sala from Nantes to Cardiff.

“The Fifa players’ status committee, which never lost sight of the specific and unique circumstances of this tragic situation during its deliberations on the dispute at stake, refrained from imposing procedural costs on the parties.

“The findings of the decision were notified to the parties concerned today. Within a deadline of 10 days, Cardiff and Nantes can request a copy of the grounds of the decision, which can be appealed to the Court of Arbitration for Sport in Lausanne.”

Cardiff have been told they must pay €6million (£5.3m) to Nantes for the transfer of Emiliano Sala as FIFA have stepped in to resolve the dispute.

The Welsh club, who had concluded all the contractual paperwork for their record 17m euro (£15m) signing, attempted to prove that culpability for the crash which killed the 28-year-old old lay with the French club - a strategy the hope will allow them to reduce their financial exposure.

But at a meeting held during the FIFA Players' Status Committee last week, football's governing body ruled Cardiff must now pay up for the deal concluded in January before he died.

Cardiff have been told by FIFA that they must pay Nantes £5.3million for the transfer of Emiliano Sala after the two clubs failed to reach an agreement over the player since he died

The next step means that now a decision has been delivered, both clubs have a period of 10 days in which they can request a copy of the grounds which led to the decision and sum owed.

If either party is unhappy then an appeal can be lodged and the case will go to the Court of Arbitration for Sport in Lausanne.

A statement from FIFA on Monday read: 'The FIFA Players' Status Committee, which never lost sight of the specific and unique circumstances of this tragic situation during its deliberations on the dispute at stake, refrained from imposing procedural costs on the parties.

'The findings of the decision were notified to the parties concerned today.'

Nantes and Cardiff have spent months trying to reach a resolution on who was responsible for the player and whether the transfer was null and void.

The Argentine, who was 28, died in a plane crash in January while travelling from France to join his new club after the aircraft plunged into Hurd's Deep, one of the most perilous areas in the Channel.

Cardiff had argued they were not liable for the £15m fee because Sala was not officially their player when he died, despite pictures showing him at the club holding the shirt just days prior.

Looking at it that must be a one off payment otherwise they could simply said city must honour original contract? Looks like it's a compromise and if I was city unless there is a caviat we dont know about I would pay up and draw line under things.

If Nantes do not appeal it will have cost City £6mill say after the lawyers costs, you could say City have done well saving money, yet the whole episode stinks and looks bad to the outside world

Yes it does sound like we pay just 5m and no more? Or surely they would say need pay 16m?

Cardiff have been ordered by FIFA to pay £5.3m to Nantes for the transfer of Emiliano Sala.

The sum corresponds to the first instalment that Cardiff were due to pay the Ligue 1 club, as per their deal for the transfer of Sala agreed on January 19.

"The FIFA Players' Status Committee, which never lost sight of the specific and unique circumstances of this tragic situation during its deliberations on the dispute at stake, refrained from imposing procedural costs on the parties," a FIFA statement read.

FIFA says both clubs will have the opportunity to appeal the decision to the Court of Arbitration for Sport in Lausanne.

The second instalment is not due until next year. They will order us to pay that when it becomes overdue

Re: BREAKING: CARDIFF MUST PAY £5.3 MILLION FOR EMILIANO SAL

Mon Sep 30, 2019 3:53 pm

So the big question is,

Was Emiliano Sala officially a Cardiff City player?

I have always been told he was.

My reading of all this says he was.

Be interesting what City now do next, they should pay now and be grateful it’s not more.
Appealing I feel will cost us more in solicitors and leave us looking once again the bad ones.

It’s so sad it ended up like this.

This suggests we only need to pay the first instalment. Not the others.

I hope we don't appeal this, just pay it and draw a line under it.

That’s the only amount outstanding at the moment. I hope you’re right but I think they’re saying the contract is valid

They may well suggest that but the wording suggests otherwise? But city are seeking clarification ! The clue really is in fact that both clubs can appeal why would nante appeal if they knew they were going to get 16m ?

I’ve just been told FIFA have said Emiliano Sala was registered as a City player and was ours at the time of the crash and if we don’t they will add on costs & our own costs in solicitors will be a fortune.

This seems to be the whole quote which to my reading would say the opposite.

"The sum of 6m euros corresponds to the first instalment currently due in accordance with the contract. For confidentiality reasons, we cannot comment at this stage on potential future instalments or other conditions of the transfer agreement."

Certainly needs some sort of clarification.

Yes this is just the 1st installment - so it looks like we will have to pay the lot. However - Dalman has said all along that we will pay what we contractually owe - so I think we will pay the installments as and when they fall due.
