Bluebirds chiefs today sent legal letters to the Premier League club and their sporting director, informing them they intend to pursue a claim for financial damages.
Cardiff City are set to launch legal action against Crystal Palace and Iain Moody in the wake of the ‘spygate’ scandal, we can reveal.
Bluebirds chiefs today sent legal letters to the Premier League club and their sporting director, informing them they intend to pursue a claim for financial damages following the furore.
Palace were found guilty of breaching Premier League rules earlier this week following a four-month investigation sparked by the Bluebirds’ furious complaint in April.
Cardiff accused their rivals of obtaining Ole Gunnar Solskjaer’s starting XI before the crunch clash on April 5, a match the Bluebirds lost 3-0 as their season imploded before ending in relegation.
The initial complaint centred around Palace sporting director Moody, who was dismissed by Cardiff owner Vincent Tan before taking up a post at Selhurst Park in November.
It was reported Cardiff believed Moody had used his contacts around his former club to find out which players would start for Solskjaer at Cardiff City Stadium.
Moody rejected the claims as “incredibly, extraordinarily untrue”, but the Premier League ruled Palace had, in fact, broken rule B16 of the Premier League handbook, which states clubs must behave towards each other “with the utmost good faith”.
Despite the Premier League side facing a fine of up to £25,000 following the guilty verdict, Cardiff chiefs are believed to be angry they have not received an apology and are determined not to let the matter rest.
The letters sent to Moody and his employers do not contain specific details of the claim at this stage, but it is understood the loss of earnings caused by relegation will probably form part of the action.
On average, clubs who drop out of the top-flight incur a loss of around £20m, including a massive loss in TV revenues.
At the time of the fixture at the centre of the storm, Cardiff were one point adrift of 17th spot. They went on to finish bottom of the table, while Palace, under the guidance of Tony Pulis, finished 11th following an incredible run of form.
In a separate twist to the dispute between the two clubs, former Cardiff boss Malky Mackay, who was also sacked by the Bluebirds following a bitter bust-up with Tan last season, is favourite to replace Pulis as Eagles boss this week.

A breach of PL good faith rules isnt law

A 3 points swing would affect final rankings - which in turn determines an "x" amount of money.
So yes - it kind of does make a difference.

Svenman87 has explained exactly what difference it would have made. The people who are against us suing Palace are people against the current regime.

I'm not saying we'll get that difference - or even anywhere near it. Merely the fact that 3 points does make a difference and even if we end up making 50k after its all said and done - I'd say its worth pursuing.
Its not tossing our club through the mud. They were found guilty of breaking the rules and as a result of cheating a punishment is inevitable.

It's impossible to say how many points it cost us, if we had won maybe we would have won a few more points, as confidence grew, and maybe they would have gone on a losing run. It's never that simple in football..........

Why give in? Who cares if we went down by six points or the game was easily won by Palace.
Go for the jugular and don't let Moody rest on his laurels.
I don't even care that it's embarrassing or others may laugh. I bet they thought a slap on the wrist and a £25k would be the end of it.
By the end of this Moody will be shell shocked and will be second guessing every ratish sneaky move he ever contemplates.

We will get £1.5m minimum out of this, so yes it very much is worth and we should be doing it.
On Bluebina's point on the timing etc - the F.A. just came back with their verdict and we've launched this case straight away.
I support the club fully for doing this. I don't like how apathetic some fans are about this incident. That game killed our season last year.

My view - good move.
This is a business, not Sunday morning vets league.
I'm no big fan of Tan, but for me Moody looks vulnerable and this is worth a punt.
Puts a marker down for any other snitches too.

I was thinking that maybe the departure of Pulis has something to do with this as well because make no mistake about it Palace would have been informed of this decision days before the PL made it public.
If our club is going to make a claim for damages, and that's all it can do, then surely the club will be citing "Breach Of Contract" because whilst I'm no lawyer I'm sure one measure of BoC is the how the behaviour of the failing party comports to standards of good faith and fair dealing.
Palace have been found guilty of failing to behave with the upmost good faith and honesty to another PL club.
The result is gone and cannot be changed but surely our club has a case for damages against Palace, maybe Moody personally, for breach of contract and are right to fight for whatever they can get for an underhand piece of dealing.

Rules were broke fact , I hope the club take it further , the thing is yes palace would have won anyway but only one stupid person in all this and that is Moody.
I hope he suffers as he caused mayhem at our club and Mackay did so if you are looki g to blame someone Moody is

And people get sues for breaches of good faith. It would be a civil suit. It does not need to be 'law'

The FA fine has strengthened the clubs case, they basically said there was wrongdoing on their part.
All because Moody thought he was a clever little so and so.

If you're going to sue anyone (which imo you shouldn't be as it's ludicrous), then shouldn't you be suing the person who leaked the info rather than the person/club enquiring after it?

Moody deserves it after ripping our club of 7 million for a striker who couldn't play football certainly not at our level he and of course Malky tore millions out of the club and we all backed them and turned even more on Tann when they were removed.
And what happens they drop all claims against Tann and say sorry mr tann and then Tann comes out and totally takes them
apart proving that they stink of guilt.

He was an employee of palace which makes both liable! tbh nj its about a principle palace tried to gain an adavantage by breaking a rule of premier league! Tan is just out to prove point wether its worth it thats tans choice & right as owner of club. Its nothing to do with us being relegated its about tan wanting pound of flesh or moodies in this case.

Intriguing. It looks as though the U-Turn on Malky is genuine.
Surely this is because of our legal action?
Palace are having a nightmare pre-season. Papers claim they have £20/25m to spend. Yet they have no time to spend it! Just as well as that is the same amount we are aiming to sue them for.
We will get money out of this court case.

It is indeed his right, regardless of how ludicrous it is.
But if anyone thinks similar things don't happen week in, week out up and down the country then they are kidding themselves.

Good point NJ as whilst Palace were wrong to ask whoever at our club leaked the team is worse.
Name, shame and sack whoever did it and then sue them as well.
