Justice???????????? Chelsea v Cardiff

I would not recommend anyone reads the Sun Newspaper but an old guy in work buys it and i couldn't miss the headline on the front page today which read 'Cheering yob in jail dodge celebration' It then went on to print the story detailed below but what made me spit feathers was the way these thugs were treated compared to both the City and Chelsea fans after the disturbances following our FA Cup tie at Stamford Bridge.

We all know most City and Chesea fans got custodial sentences between 6 and 36 months many for first time offences because they were charged with affray which carries an automatic custodial sentence or does it. A THUG who kicked a Good Samaritan unconscious laughs in the face of Britain's soft justice system after a judge let him off jail.


Daniel Chrapkowski, 24, raised his arms aloft with delight after getting a 12-month suspended term for GBH.

Joseph O'Reilly, 24, was in hospital for a month with a fractured jaw and bleeding to the brain.

But Chrapkowski still left Manchester Crown Court a free man.


The victim of the vicious beating recoiled in horror after seeing the yob who attacked him brazenly celebrate freedom on the steps of the court.

Joseph was kicked unconscious and left with injuries so bad he needed a metal plate fitted to his face.


But despite taking part in the savage attack - even admitting causing grievous bodily harm - jobless Chrapkowski was allowed to go free by judge Martin Steiger QC.


The tattooed lout then made a mockery of Britain's easy-going legal system by celebrating wildly outside court - punching the air in delight with both hands.


Accomplice Thomas Lane flicked a V sign and squared up to photographers as he left the building.

Shown photos of the jubilant scenes, outraged Joseph said: "I just cannot believe the way they are behaving. One looks as if he has just won an award not escaped prison for a vicious beating. The other looks like he doesn't give two hoots about what happened. They are a disgrace."


The court was told how Joseph was walking home with girlfriend Lucy Blackledge, 22, when he spotted the thugs kicking over bins and scattering rubbish.


When he asked "What on earth are you doing?" they set upon him. Lane first started "shadow boxing" as one of the gang boasted: "I've just been let out for GBH." Chrapkowski then punched Joseph in the face and tripped him making him fall to the floor.


He was knocked unconscious as he was punched and kicked in the face suffering a fractured jaw and bleeding to the brain last January.



Lenient ... Judge Martin Steiger
Joseph was taken to Manchester Royal Infirmary where he underwent 40 hours of treatment including X-rays and scans. He later had the metal plate fitted.


Joseph, a debt adviser, was in pain for weeks. He also suffered dizzy spells and in November went back to hospital after collapsing.


But despite the seriousness of his injuries, Chrapkowski, of Stockport, Gtr Manchester, was given a 12-month suspended prison term. He was also ordered to be electronically tagged.


Lane, a sign writer, also of Stockport, admitted affray. He was given a 12-month community order and told to complete 120 hours of unpaid work.


A third thug, Oliver O'Neill, 23, of Bramhall, Cheshire, had been on bail for another vicious attack at the time of the assault. He was jailed for 27 months after admitting two GBH charges.



GBH can carry a maximum sentence of five years in jail.


Joseph, from Manchester, added: "It's sickening. I feel really angry and upset - annoyed with the judge. I feel like sending him a letter asking why he made that decision. They should have all been locked up."


Girlfriend Lucy said: "Judges just go by guidelines and because it's a first offence he got off - then walked



BTW This post isn't condoning football violence because i believe if you go out looking for trouble and find it then you get what you deserve but the sentencing should not be different just because the offence is football related :o :twisted:

TBH mate if you are going to compare cases with the Chelsea vs. Cardiff game then you should compare it with other football related or public disorder sentencing.

As football fans we know the score, cause trouble and you are in deep shit. I would certainly agree that there is a huge problem with Policing and stewarding of games and frankly sometimes the thugs are on the other side of where you would expect them to be.

As for the above, judging it on its own I would totally agree the sentencing is a farce but not a farce which is uncommon. The fact is we can't afford to jail every individual who attacks another individual no matter how bad that assault may be.

The reason football fans get jailed is because they generally take part in public order offences involving numerous individuals and sometimes enveloping innocent members of the public.

The last thing any Government wants is mass public disorder so that is why football fans (& rioters in and around the country) get proportionally higher sentences including being jailed.

I'm not saying that is the right thing to do, but what I am saying is that is how it is and we all know that.

I know what you are saying and you have a fair point but let's be honest kick someone in the face and you should go down regardless of where and when it happens football related or not. Then bounce up and down which is all that quite a few of our boys did at Chelsea and you get sent down there's something wrong and it stinks :twisted: :twisted: :twisted:

If there aint enough prison places build more prisons, its simple. That lout should not be on the streets full stop.
I hope one Day someone fucks up that Judge good and proper and see if he likes it :evil: :evil: :evil:

Nukes if they built more prisons they would just fill them up with more football supporters ;)

Being serious no-one could possibly argue that the thug in the story above shouldn't be thrown into prison and if we haven't got the spaces then we should build new ones.

The trouble is building and especially running prisons costs billions of pounds and as a country we are basically broke. Not only that where do you build them?

I can remember proposals to build a prison in Cwmbran and there was uproar from the locals as they pleaded 'not in our backyard'. Also it costs more to house a prisoner than it does to educate someone at Eton :shock: and apparently the thinking is anyone who is sent to prison is in danger of becoming more criminally minded, so sentencing can be counter-productive to society as a whole.

However, there has to be stricter deterents as measures like 'supervision orders' really don't cut it. I never understand why the Judge doesn't award criminal compensation against assailants. In the example above I'm sure that fella wouldn't have been celebrating so much if the Judge awarded his victim £50,000 compensation which he would pay by direct payments taken straight out of his wages or benefits.

I’m convinced that if compensation awards were high enough it would deter individuals from attacking each other.

I don't disagree with you blueheaven but there has to be a reason why that happens. As I said Governments don't want widespread public disorder or anyone with a gripe (think Student loans) will take to the streets and smash things up.

Unfortunately football violence falls into the same category and that's why we get punished disproportionately if we misbehave and that includes bouncing up and down in front of rival fans.

Well there's an argument here.

The lad that got the hiding was giving it the "Charlie Big Potatos" trying to impress the bird he was with?

I mean, wheres your street savvy here?

You see three 20 year olds wrecking rubbish around the street so you know there must be something wrong in their heads.
Be it drink, drugs, emotional issues, whatever.
My immediate thought is to get the bird passed them without any bad comment about her.
It's a different story if that happens then you have to get involved.

From what I can gather and maybe I'm wrong, Ya man thought he'd mug of the three eejits wrecking the rubbish and this would impress the bird so much that he would get the blow job when they got home.

But it back fired!!

One lad got 2.5 years, so justice was done there.

Chief it cost more to house a prisoner than to educate someone at Eton !!! Why ? Well has it got something to do with the fact we treat our prisoners like royalty, TVs Play stations, Sky TV, we even buy Porn for Sex offenders. Then they build the best quality Gyms that us on the outside can only dream of, and then they receive a better education in Prison than any of us on the outside. We then buy them a new mattress only the best when they demand it and pillows as if they dont the Prison can be sued. In fact they can sue for nearly anything. That is why it cost so much to Jail them.
Sorry but what about bread and water and hard Labour. Oh and stop putting Football fans in prison for doing naff fooking all.
