PARKING FINE LAST NIGHT - ADVICE PLEASE

Thu Sep 22, 2011 8:42 pm

Others have asked in the past...but I got a parking ticket last night, parked next to the Subway Shops.

Thought I was ok as it was dark, quiet and nearly kick off.

Euro Car Parks want £70 !!!

What is the advice ?...pay up or ignore it ? :?:

Answers from people who have had them before please...

Pay up now mate they normally give you a discount if you pay within the first week gnored mine and had to pay 130 quid. Don't ignore it. They just send you letters and court letters trust me, not worth it

Ignore it mate. The court letters are not worth the paper they're written on. Don't make contact with them. I've had a few and ignored them all. Read this thread if you want to make an informed decision

Don't agree with that at all, i have had a few of these. They start by requesting your details from the DVLA and then start with the letters. IGNORE all of them, they would have to prove WHO the driver is! The driver had noticed the signs displaying the limited parking time, CCTV to show you were there for longer than the duration allowed. Basically they just hope you brick it and pay up

Each letter appears to get more and more serious but it is all just a ploy, after about 5 letters they stop

Keep the faith and ignore these crooks

Do you work for Euro Car Parks????

Just ignore it!!! They give up eventually, even after court letters. There's nothing they can do! Had the same happen at the rear of the Capitol just off Hadfield road.

Just ignore it.

I got my first one a few weeks ago, having parked there for every game!

They just rely on people paying up when they get the fine or subsequent letters. I'd ignore it (and the letters that follow)

No I defo don't work for them, lol.

But like you said they do get in contact with dvla and my personal advice is just pay it. But if like the rest have said leve it because they finally let it go then that's great. I just wasn't willing to take the chance.

Hope you get away with it.

Ps I did have photo evidence against me also. They sent me emails with photos of my car parked with signs included.

Just unlucky I guess

I'm in a similar position. I had a ticket over 2 months ago and ignored it and thought I had got away with it. Yesterday, I had a letter with photographic evidance saying my fine has now doubled from £35 to £70 and if I refuse to pay it within 28 days the fine will then be increased further to £105. I will probably pay it as with photographic evidence, I can't really argue, plus they say they'll take the "necessary means" to make sure I pay up. Do you think I should pay it or is it a ploy to worry me and make me panic into paying them the £70?

The major issue they have is it also has to prove who the driver of the vehicle is. Its a case of contract law and so they have to pursue the driver not the owner of the vehicle so the fact that they get the OWNERS details from the DVLA is irrelevant. They also have a certain code of conduct to abide by in order to get your details from the DVLA. If you watch a few of the Watchdog clips available on BBC about this matter and the Moneysaving expert pages they will outline these for you.

Basically if they have used the word fine anywhere then they have broken this. If it is Europarks they probably have on the letter threatening court action as it is a standard letter that they also used with myself. They also have to respond to any queries within 14 days though that would require a response from yourself.

I think its a ploy. All advice I have read suggests ignoring it as they have no grounds, though its obviously up to yourselves. The situation with me was I had the ticket and ignored it, had first letter and ignored it, had a second letter increasing the fine and suggesting court action should I not pay. I phoned them and told them that it was a matter for contract law which they acknowledged and I told them they were speaking with the owner of the vehicle and that they had to pursue the driver which they again acknowledged. I told them that i had not received any evidence which they were required under their code of conduct to provide and she told me she would send the file of what they had out the next day. The file never arrived so I left it and forgot about it. 2 months (so over the 14 day period) they wrote and threatening letter mentioning court action and that it was a fine (again against their code of conduct that they have to adhere to to get your details from the DVLA). I rang them up again and said much the same as above but this time the lady on the other end argued that it was the owner who was liable (completely not true), she got so tired of arguing the point with me that she said she would outline her point in a letter. Letter came again threatening court action and stating that the contents of my telephone conversation had been noted. I ignored it and had a similar one a few weeks later which I also ignored. Its now been a number of months since I have heard from them.

From what I've read; If (IF!!!) you were driving and they have no evidence they require you to incriminate yourself, which you have no responsibility to. It is up to them to prove who the guilty party was. In order for you to incriminate yourself in a court they woud have to use and ancient law (i think its called the Norwich law or something like that) which would cost them too much money and the courts would not be impressed if they did so over a £100 fine.

So what if they have a photo of your car?

This is a civil matter not a criminal one and to retrieve the money from you (& thousands of others like you) Europarks would have to spend millions of pounds on legal fees to retrieve a small amount of 'fines'

Common Sense tells you it won't happen and just to add I had the very same thing a few months back when my son parked MY car in a McDonalds in Newport but I simply ignored it and never heard anymore what so ever.

As mentioned above they use psychological pressure in an attempt to force you to pay up and if you do it would be the equivalent to chucking £70 down the plughole.

They literally need to have a video/photo clearly identifying the driver and timings of the comings and goings. Simply having a photo of your vehicle is useless. I have never heard of 1 person being taken to civil court over this, it is just scare tactics and they hope you pay for the letters to stop coming

My advice is ignore all of them - besides the letters are not recorded so they have no proof that you have actually recieved them

IGNORE IT OR REPLY AND TELL THEM TO SHOVE IT!

I had one at £70- up to £150 in Talbot Green. There was a CCTV image of me parked in a company reserved space, what they didnt know was its my best friends company, and they had never heard of this so called parking enforcement and wasnt impressed when i showed him. Sent a letter back recorded delivery and didnt heard a word back been 2 years+ now, spun that on themselves whos shitting them now!! :ayatollah:

That is a good point actually. One photo shows simply that your car was there. It doesn't show any proof of breaking any parking limits.

did you ever consider that as private land that penalties are only enforceable in subject to contract. did you contract with the car park owners? that is what would need to be proved in a court of law. how the car park owners would convince a judge you agreed to their terms and conditions of parking is anyones guess.

if this happens again. ignore.

Thanks to everyone who has replied so far.

It looks like the verdict from nearly everyone is to not pay, sit tight and see what happens.

But I'll park in Canton next time and save the hassle. :(

Re: PARKING FINE LAST NIGHT - ADVICE PLEASE

Don't pay it. There has never been a court case upheld in favour of the prosecution with regards to private car parks, I myself had a "threatening letter" from Euro car parks not two months ago.

The money saving expert website works a treat. I will be more than happy to share my conversation with Euro Car parks via email, just PM me or email me Richard@stallioncouriers.co.uk. If they don't provide contact details on your PCN then find out, they don't want to provide them because they want you to fight in there term which I ludicrous. I told them I try to do my bit for the emviroment so you will have to accept my emails. Standard.

They don't have a leg to stand on, even with photographic evidence. They can't prove you didn't use the shopping faculties, parked over the allocated time and who the individual who was driving. They say you enter a contract with them when entering the car park....BULL. A sign up on a few posts means nothing unless they cab prove that it wa properly communicated to you. All comes down to lack of evidence!!

The only parking fines I woul ever pay arethose enforced by the council.

I own a courier company and have many experiences with these companies. Please feel free to contact me for advice.

I will start a new topic for other to benefit.

Regards

Richard
