Former Cardiff City manager Malky Mackay poised to escape action by the Football Association over texts
Ex-Cardiff manager subject to probe over abusive messages although private nature of exchanges is likely to prevent FA charge

Malky Mackay appears unlikely to face any charge of misconduct from the Football Association as the investigation into the former Cardiff City manager Malky Mackay and former head of recruitment Iain Moody nears its conclusion.
It is understood that the evidence against the pair needs to be reviewed again but the likelihood is that, although there was an appetite within the FA to pursue both Mackay and Moody for alleged “sexist, racist and homophobic” text messages, the organisation has struggled to overcome its apparent policy of not acting over private correspondence.
How it tackles the so-called 'private v public’ issue remains unanswered in the FA, even though it has been claimed that there is nothing in the current rules on discrimination that makes private messages exempt.
In May the FA took no action against the Premier League chief executive, Richard Scudamore, when sexist emails from his work inbox were leaked to the press, citing that its policy was not to act on “private communications”.
Equality campaigners have demanded that the FA looks again at how it implements its rules.
The FA may feel it would have to prove such messages were disseminated more widely if it were to press charges. It began its investigation in late August and has examined texts sent by Mackay and Moody during their time at Cardiff.
Mackay has since apologised for sending messages that were “disrespectful of other cultures”. But his apology backfired when a statement issued on his behalf by the League Managers Association claimed the exchanges occurred during “friendly text message banter”.
The LMA subsequently apologised for the wording of its apology. Cardiff reported the pair for alleged misconduct in a dossier compiled by the law firm Mishcon de  Reya on behalf of chairman Vincent Tan. The lawyers even obtained warrants to search their homes.
The document is believed to also include details of their transfer dealings and thousands of texts and emails, some of which are explicit and offensive. The revelations, when they came to light, prevented Mackay taking the manager’s job at Crystal Palace and forced Moody to resign as the club’s sporting director.
Mackay was sacked by Cardiff in December and became involved in a bitter legal dispute, pursuing a £7.5 million claim for wrongful dismissal. He dropped the action in May and apologised “without reservation” to Tan, saying: “Wherever mistakes were made during my time at the club, I wish to apologise for any part that I played in them, and for any offence I might have caused, particularly to Tan Sri Vincent Tan and all City fans.”
Cardiff have also compiled documentation relating to a number of transfer deals that took place during Mackay’s time at the club, who he took from the Championship to the Premier League. Both he and Moody have strenuously denied any wrongdoing, and it now appears they will not face any further sanction.
Last night the FA would not be drawn on the possibility of whether or not charges were going to be brought against Mackay or Moody. “We cannot comment as the matter is ongoing,” a spokesman said. If the FA decide not to charge either Mackay or Moody it may not be the end of any action being taken against them should Cardiff decide to continue to pursue the matter, which they could do through the civil courts.

Yes we have moved on from MM and OLE - But the above link includes reports of transfers,which most of us found odd at the time.

Time to move on, don't care if they charge him or not.

The FA won't want to do anything about alleged dodgy dealings as its got worse not better, since the Clough days

Anybody who thinks there are not back-handers in the world of professional football, probably still believes in Santa Claus. I'm not justifying it, or excusing it, but that is the world of professional football - we just have to accept that.

If as fans we object to it then we can stop going to games. If as club owners, they object to it, then maybe they shouldn't invest in a club involved in that type of industry.

If they go ahead and invest only then to realise the real world - well, that just shows how little they actually know about the game.

MM is no different to probably 99% of managers within the game in the world.

The guy deserves respect for the success he brought us regardless of these transfers.

Former Cardiff City boss Malky Mackay set to escape punishment over text scandal - reports

Former Cardiff City manager Malky Mackay is set to escape any punishment over the text scandal that rocked football this summer, according to reports.

The Telegraph says the Football Association are unlikely to hand out any sanctions to Mackay and former Bluebirds recruitment chief Iain Moody because the alleged “racist, sexist and homophobic” texts were exchanged privately.

Mackay has already issued an apology for his part in the storm, admitting he sent three “unacceptable” texts during his time as Bluebirds boss.

An exhaustive document compiled by London lawyers acting for Cardiff owner Vincent Tan was sent to the FA in August, eight months after Mackay’s Bluebirds reign came to a bitter end. It detailed a series of alleged texts exchanged between the pair that were said to be of an explicit and offensive nature.

The evidence against the pair will now be reviewed again but the Telegraph claims the organisation has struggled to overcome its policy of not acting over private correspondence.

Yes especially when you look at who they employ to help sort out problems. A drugs cheating, racist, homophobe that is Rio Ferdinand.

You never know there is probably nothing in the dossier that Tan gave them and so Malky is onnocent of all the accusations from the proven liar that is Tan.

But others have been punished for sending private messages

Senior FA figures are braced for a furious backlash if, as expected, they fail to charge Malky Mackay and Iain Moody over their exchange of sexist, racist and homophobic texts and emails.
The FA will leave themselves open to accusations of inconsistency and weakness if they do not take action against the former Cardiff City manager and the head of recruitment who worked alongside him in south Wales. Particularly when the correspondence was passed to the FA by Cardiff City, having been obtained through a search order of Moody's house granted by a High Court judge.
The FA insist the matter is ongoing despite the fact that Sportsmail first revealed the details of the texts and emails on August 21. But it appears to be reaching a conclusion with the belief being that the FA will not charge Moody and Mackay.

so its fine to be a racist in private, but as long as you pretend you are tolerant in public thats all that matters.

the LMA need to redefine their stance on the conduct expected of its members, then.

i'll do a statement for them for free:

"Racism is completely unacceptable in all forms, unless its in private and / or banter*".

Not talking about the texts. I am on about the alleged corruption and transfer deals. :wave:
