New Generation Parking

Sat Jan 26, 2013 12:51 pm

Well it had to happen eventually, I've been sent a £60 fine for parking outside the Casino, I'm not a member I just grab a 'using le croupier' sign of the desk and stick it in the window.

I know these threads have been done before but has anyone actually ignored the letter and have action taken against them?

I'd prefer to hear replies from people with experience of dealing with this firm rather then hoards of people shouting 'don't pay it' purely out of speculation.

Re: New Generation Parking

Ive had 14 since we moved to CCS, ignored every single letter and they've given up.

They did send official looking ones from solicitors to so they follow into bin. Free parking....job done :)

Re: New Generation Parking

I've had two and first time I thought they didn't look too legit given how different they are to the ones the council issue. I got my mate who is a police officer to look at it and he ripped it up right in front of me. I shit myself. It was only after he ripped it up that he told me it wasn't enforceable and to not worry about it. He said they prey on the weak and vulnerable who would rather pay than go through any possible hassle.

Re: New Generation Parking

For so long as they can not prove who the driver is, the fine is not enforceable against the registered keeper of the car.

Ive written an advice column on this very point in the Echo & Western Mail.

Google Wales on Line for the old advice columns.

Cheers lads, luckily I was driving my beloved wife's car that day anyway, so it's all in her name, unlucky love!

Point worth noting though is the parking permit you get from the casino means feck all to these companies

Re: New Generation Parking

Just aswell the parking ticket means feck all to us then

M4S is correct Gav (we'll you'd hope so, wouldn't you).

Happened to me. I seem to remember Vinci are the CPM firm?. Google Money Saving Expert too, that's one of the sites I took advice from and ultimately didn't pay. They don't like it up 'em.

Gav I had one last season for parking in the asda car park. I looked into it and the advice seemed to ignore it. However when I had the letter I decided to write back and basically said "yes it's my car but I wasn't driving that night so suggest you take the matter up with the driver on this occasion". You're under no obligation to tell them who was.

I heard nothing back. From what I've read no car park company has ever successfully won a court case so they don't bother. So they may huff and puff but they rely on those who are frightened into paying up.

Good advice thanks, and ironically true, as I was driving my birds car

Re: New Generation Parking

Firstly, I wrote to state "Thank you for your invoice, I would now suggest you contact the driver of the vehicle".

Then you receive a scaremonger letter reminding you that under Section blah blah of blah etc it is the vehicle owners legal responsibility to reveal the drivers ID blah blah erc.

I then wrote again (Wthout Prejudice) and advised them to contact the driver and that I would be contacting the Police for harassment should they try to contact me again. Which they didn't.

If I got one again and knowing what I know, I would be tempted to just completely ignore it. They ultimately know that even if they have cctv footage of you getting out of the car, doing a moonwalk while flicking the V's to the camera, it would cost them too much to pursue. Its contract law as opposed to criminal, that latter of which you should be concerned about and pay if a ticket was issued by a council or police.

Gav, I've posted about this scam before and I don't know anyone who has had their ticket taken further after ignoring it (and the key words are IGNORING IT!!)

Happened to a close friend of mine earlier this season and I did a fair bit of research before realising the following:

FACT: Theses companies are working on the premise that people are gullible enough to pay the fines on demand and are, therefore, easy targets

FACT: The law relating to 'private' parking has recently changed and their option to 'clamp' has been removed, so they are left ONLY with the THREAT of a pretty much unendorseable fine (costs versus benefits)

FACT: The company involved can ONLY CLAIM FOR MONIES THEY HAVE LOST OUT ON BY YOUR OVERSTAYED PARKING, which basicaly means that as they didn't charge you for the first 3 hours (may be less in other areas such as Motorway Services and Hospitals, etc) then THEY HAVEN'T ACTUALLY LOST ANYTHING, have they??

DO NOT RESPOND (even when they send you a 2nd letter offering the opportunity to 'settle' at the original amount IF PAID WITHIN 3 DAYS or similar, which also says a lot) and it will go away ;)

Responding (even to say "Go forth, I'm not paying" ) is effectively an admission you were there and that in itself MAY be seen as an opportunity for them to proceed :(

hOPE THAT HELPS :ayatollah: :ayatollah:

It's not quite true that NO ONE has ever been found guilty of this so-called offence but they are exceptionally rare and (a) relied on the defendant ddropping themselves in it by responding, and (b) the fine imposed being ONLY the sum relative to that which the company has lost in parking revenue (in Asda/Casino's case a big fat ZERO) :ayatollah:

So if the letter went to your other half and not you then you're def in the clear as they can't prove you were driving and see wasn't there! The fine is against the driver not the vehicle but to all intents and purposes you don't exist!

Yeah agreed, but in my case responding to say I wasn't the driver is fundamentally different from responding and saying you were but didn't see the sign or you hadn't overstayed etc which I agree with you is an admission of guilt.

If I had one again I would ignore completely and your advice is spot on :ayatollah:

I agree, but they won't complain when the footie crowds pop into their shops before and/or after a game. In a couple of seasons it could be 30K+ :ayatollah: :ayatollah: :ayatollah:

The only ones that cant be ignored are ones from the council/police that's why they put them in official lookin envelopes but for what u got i would just say f**k em :-D

Re: New Generation Parking

Sat Jan 26, 2013 8:06 pm

Whats stopping them selling the car parks to the council for a one off sum and then the council raking in the cash by handing out fines themselves every day of the week?

Re: New Generation Parking

Sat Jan 26, 2013 8:45 pm

ignore them mate ive had 3 from 'parking on a private business car park' which happened to be my mates and theyd never heard of them! emailed them back this and never heard again! as said above their looking for easy targets! :old:

Re: New Generation Parking

Sat Jan 26, 2013 8:46 pm

I had one, ignored it, kept getting letters saying I'll have to pay £350 now or face the bailiffs. Still ignored it, sent me letters from a solicitor (think it was Mr Leek or something like that) still ignored it, and about 2 years later still haven't paid and they gave up after about 6 months max.

New generation parking are a cowboy company. The only parking fines you need to reply to or pay are from the police and council.
